Paragraph one
(1) of the "Required" clause in Section B states, "Fencing—which reflect the property's history and
development shall be retained". Additionally, paragraph three (3) of the same clause states, "Fencing
visible from the street in front of the structure shall be open and consistent with the historic character of
the structure enclosed."
I would argue that paragraph one (1) implies all fencing on a property, as it is not specific on front,
rear, or sides. Where I think the guideline falls short is describing, in more detail, locations, types,
materials and height of fencing.
Subsequent to our Board meeting, the contractor as well as HPC staff identified multiple locations
within the district in which unpainted, wood, privacy fencing has been installed, thereby setting a
previously undocumented precedent. Had the Board been provided this information prior to the
meeting, I feel that this COA would have been approved without prejudice.
file://C:\Documents and Settings\EDadlow\Local Settings\Temp\XPgrpwise\4BF507CASJ... 5/24/2010
