Page 2 of 2 <br />As I stated during the Board meeting, I would like to see this fence design modified slightly by <br />substituting a Gothic picket in lieu of the proposed dog ear, or scalloping at the top of the fence. The <br />gate facing the front yard should be lowered to the existing height and have its pickets spaced as noted <br />in paragraph three (3) of the requirements. I understand that this may cost a little more, but I feel that <br />the homeowners understood the restrictive covenants of this district when they purchased this property. <br />Finally, it is my opinion that some subjectivity could be granted in this COA, given the continuing, <br />court documented, issues that this homeowner is having with the neighboring rental property. I feel that <br />a fence is not a permanent structure and will not forever impact this property. Additionally, I feel that <br />it is more important to this district to have a good stable homeowner remain within the district than to <br />have this possibly become another rental property and potential blight on the neighborhood. I know <br />that this may be contrary to the objectivity of the guidelines, but quality of life should also be <br />considered a precedent in all districts. By continuing to reside at 712 Forest Ave., this homeowner is <br />sacrificing his. <br />Thank you <br />David B.
