Hostetler: Yes, on this part of the property. He just wants to completely enclose it for security
purposes.
Chase: And there's no problem being on two separate...?
Hostetler: No. I checked with the Building Department, they're good with it as well.
Zeiger: What's the height of the chain link?
Hostetler: 6 feet.
Zeiger: 6 feet?
Hostetler: It's just going to be a regular standard chain link fence to match the one that's there;
it's not going to increase in height.
Klusczinski: So are you sure it's 6 feet?
Hostetler: The stockade fence will be 6 (ft), but I don't know about the chain link, I'm assuming
that it's going to match up with the rest of their chain link fencing.
Klusczinski: Other thoughts?
Riley: I have a question of Lynn, is that appropriate now? You're in that District...
Patrick: Yeah, this is consistent with what's going on there. If I'm correct, this is this big green
house that's empty and it's real close to his business. I'm assuming that the stockade in back will
help give him some privacy there from the alley. I don't think that they neighbors would have
any problem with it. You can see from the pictures that he's given that it's going to come off of
the back of the house so it's not going to be on the front on Lincoln Way. It is a large lot.
Zeiger: But they're fencing this empty lot to the side of the house.
Hostetler: Right, he's buying that on land contract.
Zeiger: So that fence will go along that front, at the set back of the house, 6 feet tall?
Patrick. Mm-hmm.
Hostetler: Chain link, right across there.
Patrick. He also has a dog; he might want to have his dog out there. Though he hasn't told me
that specifically.
Riley: There doesn't appear to be any fence in the front which they mentioned.
Hostetler: No, there isn't one, that's why he wants to put on there. That's why they want the
chain link there.
Klusczinski: Any other questions? In that case, we move to public hearing. Any members of the
public wishing to speak in support of the current petition? Hearing none. Any member of the
public wishing to speak in opposition of the current petition? Also hearing none, Chair closes
public hearing. Any additional thoughts, Commission? Hearing none, is there a motion?
Chase: I'll make a motion that we accept 2008-0606 as presented in the C of A and the
recommendation of staff.
Riley: Second.
Klusczinski: Motion has been made and seconded, without amendments. Any additional
discussion? Hearing none. All those in favor? (Ayes are heard) Opposed? (Ayes are heard)
There are two in opposition. Timothy Klusczinski opposed. There isn't sufficient information
without the petitioner being her a to represent this particular case and to answer questions to make
sure that the height of the fence would be reflective of what the District standards would be.
Hostetler: He has to get a building permit for it. So it would have to confer to building...
Klusczinski: That's not necessarily C of A or guidelines.
Zeiger: I don't feel that a 6 ft chain link fence in the front is in keeping with the guidelines.
Hostetler: But it is.
Klusczinski: The C of A passes by a vote of 3-2.
Moved: Chase Second: Riley
Moved to approve 2008-0606 Approved 3-2
Zeiger, Klusczinski opposed
Application Number: 2008-0703
Property Location: 521 River
Property Owner: Neal Nowak
2
