time to gather information. Do you want time to gather information or do you choose not to
allow for that scenario and want them to take action as quickly as possible?
Juszczyk: I do not need anymore time.
Peterson: Ok.
Sporleder: I would still like to suggest that even if he doesn't need more time with what to do I
think that the Commission can be of some assistance in finding out the information. As I said, I
might be able to find the drawings and that might be helpful in ascertaining what the structure is,
where the valleys are, what's actually under there, etc. I really would like to pick up on what
Linda said. And, if we have to hire someone to come in and look at it, I think that we should be
prepared to do that. In addition, I think that Catherine and staff possibly could help find a grant
that might... they have really taken on a courageous thing taking on that church. It's one of the
most historic churches left in South Bend and it wasn't in good shape when they got it, and it was
in danger of being torn down when they got it.
Klusczinski: Joann, and for the purposes of the motion on the table, I just want to make a
clarification that although those are great recommendations they're not part of the original
motion that's been made and seconded.
Sporleder: I'm just encouraging us to take the time that we need to find out.
Klusczinski: Absolutely. To assist them in any way possible. Motion has been made and
seconded to table C ofA 2007-0904. Applicant indicated that time was not an issue either way
other than the potential destruction from the leaking roof that he has to deal with right now, but
we're not stalling a project that he has planned and contracted.
Juszczyk: Uh, yes you are. I had a permit and you pulled it. So you are stalling a project that I
have planned.
Herdman: No. A C ofA was issued based on inaccurate information that the roof or the portion
of the roof in question was being replaced in-kind. The person that came to get that permit didn't
understand that terminology and lead us to believe...
Klusczinski: And that asphalt shingle was the result?
Herdman: Exactly.
Klusczinski: That C ofA isn't valid, that's why this one...
Juszczyk: All I'm saying is that I was planning to do these repairs and that you ARE stopping me
from doing it.
Klusczinski: Fair enough. Any other Commission discussion on the topic? Hearing none, I call
for a vote. All in favor? (Ayes) Opposed? (Silence) Motion to table C ofA 2007-0904 pending
an investigation and other assessments on repairs passes.
Herdman: Do we need a motion to charge us to do that work, or do you prefer it to go to
committee?
Hostetler: Do you want to put this in Standards and Maintenance? In landmarks?
Klusczinski: I'm going to make a suggestion that we leave it to staff to work out, and if they get
in over their head, then they can ask for.
Hostetler: None of us are experts in slate roofs.
Klusczinski: No, but so far as being able to pull contractor information and maybe hear the
assessments that they're trying to gather.
Herdman: I can do that.
Peterson: As a clarification, the ordinance allows for 45 days, not 60 days. So, it's 45 days, so
you'll have to act on next meeting.
Sporleder: Sir, is there anybody, uh do you have a congregation here? And would there be
anyone there to let us in or to look at the roof.. We wouldn't want to go on the property unless we
had someone there.
Juszczyk: I can make arrangements to have someone hereto open the doors.
Klusczinski: And our staff has your contact information? Ok.
Moved: Choitz
To table C of A 2007-0904
Second: Sporleder
Approved Unanimously
6
