Todd Zeiger. I am voting in favor of the motion to deny this C of A as it does not follow the guidelines as <br />set forth for Chapin Park <br />Lynn Patrick. I am voting to deny application 2006-0418 as it does not meet the guidelines for Chapin <br />Park specifically the following: Original windows and doors shall be retained including sashes, lintels, <br />sills, shutters, decorative glass, pediments, hoods and hardware. When deteriorated beyond repair, they <br />shall be replaced with units and trim resembling the original. If new sashes or doors are installed, the <br />existing or original materials, design and hardware should be used. And in particular the finding that <br />new window and door opening, which would alter the scale and proportion of the building, may not be <br />introduced. <br />Tim Klusczinski: I am voting in favor of the motion to deny the C o A as it would alter the scale of the <br />building and this is not recommended in the guidelines just mentioned. <br />Martha Choitz: Raising the lower edge of the windows does not meet the guidelines of Chapin Park and I <br />vote yes to deny. <br />Jerry Ujdak: I am voting to deny for the reasons stated previously. <br />Catherine Hostetler. I vote to deny the CoA as it does alter the scale of the windows and this would be <br />visible. This is not recommended in the guidelines for Chapin Park <br />The motion passed 8-0, all in favor of the denial of the Certificate of Appropriateness 2006-0418, 865 <br />Forest Avenue, South Bend, Indiana. <br />2.2006-0501: 121 Studebaker <br />Catherine Hostetler read the staff report and the owner, Nina Porter, was present with Ron Perry, who was <br />representing Dennis Moody, the contractor. <br />Joann Sporleder moved to approve Certificate of Appropriateness 2006-0501 as presented [with back - <br />primed tongue and groove porch decking and a shaped rather than squared off handrailj. Jerry Ujdak <br />seconded the motion and it passed 8-0. <br />3.2006-0505: Shetterley Park <br />Catherine Hostetler read the staff report and the Chair then recognized Jason Durr, Assistant City <br />Engineer and David McCormick, Managing Engineer of Christopher Burke Engineers. A handout of <br />shallow rooted trees and shrubs from the State Forester was submitted to the Commission. These shallow <br />rooted trees could be planted over the pipe alignment to shield the pipe without causing damage by <br />invasive root systems. <br />Jason Durr stated that the City had recently received approval from IDEM for this proposal. David <br />McCormick stated that the current plan would reduce the footprint of the project by at least 50% and the <br />trench width for the project would be reduced with the use of trench boxes (the cuts for the trenches will <br />be very deep — 30 ft in some cases). The project will also maintain existing grades. Odor control will be <br />attained through submersion of the pipe; a duckbill valve will no longer be needed. <br />The City agreed to amend the application to say that the City will replant trees, reseed the area and <br />provide erosion control. <br />The Chair recognized members of the public who wished to speak on this matter. <br />Brendan Crumlish, 1021 Riverside Drive, thanked the engineers for the redesign of the project and noted <br />his one concern — that the trees mentioned in the State Forester's report were not native species. This <br />would leave a big question mark for the fixture look of the park. Brendan suggested the use of deep- <br />
