COMMITTEE REPORTS <br />JOHN LIVINGSTON: We met with Temple Beth -El and Chapin Park Neighborhood <br />Association and interested neighbors within the district to try and come up with some sort <br />of compromise that would allow Temple Beth -El to expand in the future if such need <br />ever becomes apparent. <br />The west side of the block where Temple Beth -El is located will have its own <br />standards to allow for a possible removal of certain buildings at such times when Temple <br />Beth -El acquires those buildings and then decides that they need more room on their <br />campus for educational buildings or other buildings. <br />If they purchase a building they agree to take care of that building and keep it up to <br />standards until such time that they would have to use it for their temple purposes. They <br />shall then follow the normal procedure of filing for a'C of A, which is spelled out in the <br />city code as well as in the state law. <br />The Indiana Code also provides that to demolish a building or to remove a building <br />within the confines of a historic district one must seek a C of A. Upon the grant of this C <br />of A, Temple Beth -El then would have a certain period to advertise the sale and <br />relocation of these properties. The preferred method is that these historic structures be <br />moved rather than be demolished. They would offer these buildings for $1.00 dollar with <br />the relocation expenses to be borne by the buyer. The structures would be offered for a <br />period of not less than 180 days with the possible extension of an additional 60 days at <br />the request of the Historic Preservation Commission or the neighborhood organization. <br />This paragraph would not constitute a waiver of any of the zoning or building code <br />sections of the South Bend Municipal Code. It would apply only while Temple Beth -El <br />owns these properties. If these properties should be sold to someone else then the waiver <br />would not apply. It would also apply if Temple Beth -El were to move; then the waiver <br />would expire. This particular section is in paragraph I of section 5, the general section of <br />the Chapin Park Local Historic Preservation Guidelines. <br />There was also a small change to paragraph F, which would read: "All guidelines <br />will be reviewed and updated upon the recommendation of the liaison committee at least <br />every five years with on going consideration and respect given to Temple Beth -El's <br />exemption with regard to demolition or the removal of Certificates of Appropriateness." <br />We have worked on this since September and I believe that we have come up with a fair <br />solution for this.
