93 <br />94 CHERYL GREENE: I gave the Commission an opinion on July 17, <br />95 2000 during which I referenced a July 10, 2000 telephone conversation I had with <br />96 David Duvall of the Department of Historic Preservation and Archaeology. During <br />97 this conversation Mr. Duvall stated that as far as DHPA was concerned the lighting <br />98 issue was local and a matter for this Commission. He also noted that it was unlikely <br />99 that the DHPA would take a strong position against the lighting. Mr. Duvall could <br />100 not confirm whether or not the applicant had received approval from the DHPA for <br />101 the lighting do to the large number of applications received by them. He further <br />102 expressed that removal of the lighting may cause damage to the roof. I asked Mr. <br />103 Duvall to send such a statement in writing and I have yet to receive such a letter. <br />104 The applicant has now officially submitted an application for the roof top lighting. <br />105 The Commission does have the discretion under municipal code section 21-117.15b, <br />106 to approve the application if the Commission determines denying the application <br />107 would cause a hardship to the petitioners. <br />108 <br />109 JOANN SPORLEDER: Could you please read the current application. <br />110 <br />111 RHONDA SAUNDERS: The application states the following; installation of <br />112 monumental lighting on top of the existing courthouse with four locations see <br />113 attached roof plan and product cut sheet. <br />114 <br />115 CHERYL GREENE: I received numerous phone calls regarding this <br />116 issue which led me to get approximate cost estimates for removal and replacement <br />117 of the existing lights. It will cost thousands of dollars to remove and replace the <br />118 lights. <br />119 <br />120 JOANN SPORLEDER: Can we deny the application with out forcing the <br />121 applicant to remove the lights? Can the matter simply drop after denial? <br />122 <br />123 CHERYL GREENE: I do not know if what you ask is possible. The <br />124 Building Commissioner cannot issue a building permit with out a Certificate of <br />125 Appropriateness from this Commission. <br />126 <br />127 JOANN SPORLEDER: I do not want to put the Commission in the position <br />128 where we would be liable. I do not think the Commission should approve something <br />129 that clearly violates the Local Landmark Standards as well as the Secretary of <br />130 Interior Standards. <br />131 <br />132 CHERYL GREENE: Once again it is the Commissions discretion to <br />133-- either deny the application out right and ask for their removal, you could deny it <br />134 and not ask for removal or you could deny it and note that should anything happen <br />135 to this lighting it cannot be replaced with out obtaining approval from this <br />136 Commission. <br />137 <br />3 <br />
