93 After due consideration, the following action was taken: <br />94 <br />95 Upon a motion by Joann Sporleder, being seconded by Jerry Weiner, the motion <br />96 to approve application 2000-1116 as submitted failed with Martha Choitz, Mary Jane <br />97 Chase, Richard Helmus and Richard Morrison voting against and Joann Sporleder and <br />98 Jerry Weiner voting for. <br />99 <br />100 RICHARD MORRISON: I move that application 2000-1116 be placed into the <br />101 standards and maintenance committee as recommended by staff. <br />102 <br />103 RICHARD HELMUS: I second the motion. <br />104 <br />105 After due consideration, the following action was taken: <br />106 <br />107 Upon a motion by Richard Morrison, being seconded by Richard Helmus <br />108 and carried with Joann Sporleder opposing, application 2000-1116 was placed into the <br />109 standards and maintenance committee as recommended by staff. <br />110 <br />111 <br />112 2. 2000-1130 — 406 West Madison, demolition <br />113 <br />114 JOHN OXIAN: The Commission will be signing a contract with South Bend <br />115 Heritage Foundation to allow Paul Hayden to be our part-time inspector. I have also been <br />116 in touch with the property owner, John Freidline, who presented me with a letter today. <br />117 His letter states that Mr. Freidline had sold his interest in the property in March of 2000 <br />118 to the Indiana Land Trust who intended to repair the property and run a business from it. <br />119 The land trust has restricted financing so the repairs would take a while to complete. The <br />120 buildings current condition is not harming anyone and with an investment of $10,000.00 <br />121 to $15,000.00 the structure could be brought up to code. Code Enforcement has not been <br />122 inside and Mr. Freidline has stated that he would allow us inside to inspect the interior of <br />123 the building to get a better understanding of its condition. <br />124 <br />125 KATHY DAVIS: I am the Director of Code Enforcement. I am not sure anyone <br />126 should go inside the structure since the roof has collapsed. <br />127 <br />128 JOHN OXIAN: For the Commission to make an educated decision regarding this <br />129 property our own inspector should be sent to investigate the property inside and out in <br />130 order to submit a complete report next month. That is why the staff is asking that the <br />131 application be tabled for a month. <br />132 <br />133 KATHY DAVIS: I appreciate the Commission's interest in getting inside the <br />134 building;, however, we do have some public safety concerns. There is collapse to the <br />135 roof at this time and a west wall that is severely bowed and leaning extremely close to the <br />136 neighboring house. We have concerns if this wall should kick out it would fall into the <br />137 neighbors property and with the population density in this area some one may get hurt. I <br />M <br />
