Legal
Mrs. DeRose noted that Charlotte Pfeifer had asked her to look into the stipulations on
the deed for the Natatorium. She stated that in her research she found it to be clear that if
the property is not used as a natatorium then the property reverts back to the original
owners heirs.
Mr. Ujdak asked if there were any living heirs. Mrs. DeRose stated that she did not know
if any heirs still exist, however, it's the City's duty to investigate. She further noted that
it is a very classic restrictive deed.

Mrs. DeRose announced that she has been promoted to the Chief Assistant City Attorney,
which gives her more duties causing her to step down as the full time attorney for the
Historic Preservation Commission. He went on to read a letter from the
Director of Public Works thanking the Commission for working with them to solve the
various snags in the project, such as the cracked pole. In the letter the Director stated that
Public Works would repair the cracked pole on the island near Twyckenham and would
offer the owners on Sunnyside, Jacob and Esther the placement of bushes to buffer the
impact of the utility boxes. Mr. Oxian noted that the final issue that could not be agreed
upon was what to do about the new poles in the district that are missing the collar
elements. He noted that the Public Works Director has requested that since they do not
currently have enough collars for all the poles, that those poles already in place be left as
is and that any poles installed in the future would have the collar. Mr. Oxian stated that
he would like Commission members to go out and look at the streetlights in the East
Wayne Street District so that the Commissioners can make an informed vote on the topic
next month. He went on to note that the new poles are not made with collars and that the
City would have to have them specially made. Mr. Oxian stated that the residence of
East Wayne like the new lights without the collars, however, the Historic Preservation
Commission Director, Mr. Talley, is adamant that the collars be installed on all fixtures.
He further stated that the remaining seven original poles in the district would retain their
C
