359
360 C. STANDARDS AND MAINTENANCE
361
362 - JOHN OXIAN: There is nothing new to report.
363
364 5. STAFF REPORTS
365
366 A. Staff Approvals
367
368 RHONDA SAUNDERS: A list of staff approved certificates was included in the
369 monthly packet.
370
371
372 B. Legal
373
374 CHERYL GREENE: I was contacted by the members of the Standards and
375 Maintenance Committee regarding the roof top lighting of the 1855 Courthouse. I was
376 asked to confirm whether or not there had ever been a Certificate of Appropriateness
377 issued for the roof top exterior lighting. I reviewed all the minutes, the applications
378 submitted by the St. Joseph County Commissioners, correspondence from the Architect
379 and Department of Natural Resources, Division of Archaeology and Historic
380 Preservation. After reviewing all of the material it is my opinion that the architect did not
381 reapply for a Certificate of Appropriateness for the exterior roof lighting. In February 8,
382 1999 the architect submitted a second Certificate of Appropriateness application, which
383 did reference exterior lighting. That came before the Commission on February 16, 1999
384 at which time the Commission approved the Certificate of Appropriateness with
385 exception of the windows and exterior lighting. As of February 16, 1999 the exterior
386 lighting on the courthouse was denied. The architect has since tried to amend the
387 Certificate of Appropriateness in order to have the lighting approved, however, he has not
388 submitted anything in writing. Therefore, the lighting on the courthouse is not in
389 compliance. It is my recommendation that legal consul send a letter to the architect and
390 property owner that they submit an application for the roof top lighting for the
391 Commission to review. Since I serve at your pleasure I need some direction.
392
393 MARTHA CHOITZ: I move that legal consul, Cheryl Greene, pursue this matter
394 by sending a letter to the owner and architect outlining her findings and the need for a
395 new application to be submitted for the roof top lighting.
396
397 GERALD UJDAK: I second the motion.
398
1
