Commissions denial-:
Mr. Harman asked if there was a way_ he could oppose the.COmmissions denial.
- Mrs . _ DeRose . stated that Mr.- . Harman has : the.. -.right , to. .appeal._ -by, .: way. of . the - .
appeals.process set forth..in the.'County Ordinance. Mr. Duvall .stated that an
appeal:is'. to a•.finding: of,.a Certificate.-.of__Appropriateness application. - Mr.
Duvall noted. that this petition came about from the•Area.Plan Commission when—
Mr. Harman applied _for rezoning of.'the"land to allow a construction of single
family -home which was.-approved,in the.Public Hearingportion of the meeting.
He also stated -that he did not feel that a request for removal from a Landmark.
was an appropriate item for a Certificate.of Appropriateness because'it's part.
of the Landmarking. .procedure ...andnot, part of. the Certificate- of.
- Appropriateness procedure. Mrs. DeRose stated that Mr. Harman's next course
of action, would.be...a.review, however, she did not know.. whether. itwould be a
judicial review or review.
by County Commissioners. . Mr. -Duvall. noted that
---
-by.point-of -order this petition.was.not.-located. in. the public hearing section
- of the agenda,' it. was.. in_fact, a.,Committee report: He also stated . that .in Mr.
Selsor's case he, -.had. received. a -Committee report and then requested a public
it being a.Landmark until two days before he signed on the property. He still
does .,not understand what his: -16 acres has -to do with- the Landmark house and..
how it would be, advantageous,to him'to remain under Landmark designation..- Mr.'
Fine stated --that, itprobably... is: not_ advantageous -to- Mr..=...Harman,- however, the _
reason "why.v-it .t.i s;• des ignated.-and.,why.-it should:: be designated. is 'that. -.a lot of
areas. like_ this..one do get developed into ..subdivisions. -.and eventually that
farm house does. not have. -its ''character or .original setting,.. causing it to
lose . its farmstead look.. ..'-Mr. Fine further. stated that. the .land may .not be
developed while. Mr. Harman_ owns:_. the .land, -but,.who, knows what will happen
after it.- is sold to, someone else._ Mr. Fine. reiterated. that it isnot
to this , particular.. piece _. of-...-. property. .. Mr-.. Harman . stated that ...their main
attraction to the property was -that it is. right--off-'a.main road and that -they
do not have to install a very -expensive septic system. :Mr. Harman asked that
even though this relitionship.would not benefit either -side his property would
wanted:-to.-build..a..pony.-.barn__he would..have tto-. come -back. to. -the -Commission for
permission. Mrs. _:Sporleder;'stated ._that was "true,.- however;- Mr. .Harman would
have., to come. _in., and_..get.,a.. building. permit anyway -,and . that, he -would Just have
to pass through on'his.way.to-the Building.Department:_-Mr.:-Oxian stated.'that
Mr. Harman was „just looking at.. this.. situation, for_ today.,` .just. -.like. everyone
the property and what they -will do with _ it. He went on to. state . that maybe
Mr.. Harman. does not want- to, do anything detrimental,- but, 'there .is no
guarantee... that- iahen--it'. passes .. out -of - Mr Harmans _. hands, that -the ..next owner .
