0 approved. <br />IV. Regular Business <br />A. Approval of Minutes - January 15, 1996 <br />Mr. Oxian tabled consideration of the minutes until the March meeting to allow <br />sufficient time for their review. <br />B. Treasurers Report <br />The Treasurer made no report. <br />C. Correspondence <br />Mr. Duvall Indicated that due to his accident, he had not had an opportunity <br />to develop the correspondence report for this meeting. <br />D. Committee Reports <br />1. Budget & Finance <br />Mr. Wiener indicated that there was no report for this month. <br />3. Legal <br />Mrs. DeRose indicated that she had not yet had an opportunity to study <br />alternative forms of certification. She sought clarification of the desire of <br />the commission for a device to allow after -the -fact approval of work done <br />without COA which conforms to the standards and guidelines. She noted that <br />amendment of the ordinance might be required to accomplish this end. <br />Mr. Oxian observed that a tree had been removed at 1202 Lincolnway East <br />without COA. He requested that Mrs. DeRose send a letter to the owner <br />requiring replacement of the tree. Mrs. DeRose inquired as to whether the <br />owner had probability of sufficient resources for such a replacement. Mr. <br />Oxian indicated that he believed so. Mr. Talley observed that the area around <br />the former Potpourri site was receiving new sidewalks, and that another nearby <br />house had recently removed a tree from the tree -lawn without COA. He noted <br />that the tree removed from the tree -lawn should have required city approval. <br />Mrs. DeRose inquired what was known of these trees regarding description. Mr. <br />Talley indicated that the first tree discussed was of approximately three feet <br />in diameter and was located at the north corner of the lot near the tree lawn. <br />Mrs. DeRose asked about the applicability of evidence the owners might have of <br />necessity from tree horticulturists etc. Mr. Talley responded that the <br />question at hand was whether procedures had been properly followed without <br />regard to the merits of the action. <br />4. Historic Districts <br />Mr. Oxian observed that there had been an article in the South Bend Tribune <br />about the proposed Lincolnway West Local Historic District and that he had <br />received only positive comments. <br />5. Historic Landmarks <br />A) Mr. Oxian reported that the status of local landmark proposal for <br />534 LaPorte remains tabled by the Common Council but has not been withdrawn. <br />He requested that other members should visit the site and give comment as to <br />whether the commission should reactivate this recommendation or drop it in <br />light of the brick veneer which has been added since the proposal was tabled <br />by the Common Council. Mr. Talley inquired about the underground tanks. Mr. <br />Oxian indicated that they were still in place but should probably be required <br />to be removed. <br />
