Mrs. Choitz seconded the motion. The motion passed unanimously. <br />B. Treasurer's Report <br />There was no treasurer's report. Mr. Wiener indicated that a second quarter <br />report would be submitted at the next month. <br />C. Correspondence <br />Mr. Duvall indicated that the office had received a letter from Philip Schatz <br />of 1027 East Wayne requesting technical information on the repair of stucco. <br />The office has sent a violation letter to the owner,of 971 Riverside Drive and <br />a letter of support for the.NIHS project "Cornfield to City" about River Park, <br />a letter to American Electric Power regarding the removal of a streetlight <br />from the East Wayne district without COA, letters to the Shands and Peter <br />DeKever giving notice of the designation of their properties as landmarks, and <br />letters to the South Bend School Corporation and the Michiana Academy of the <br />Performing Arts regarding minimum maintenance standards at the Oliver School. <br />D. Committee Reports <br />1. Budget & Finance <br />Mr. Oxian observed that County budgets would come up for consideration soon <br />and the committee should meet to consider this. <br />3. Legal <br />Mrs. DeRose indicated that most of her concerns were in the agenda under Staff <br />reports except the proposed PHC Zoning District amendment. Regarding this last <br />• item, Area Plan Commission's Council had indicated that they felt the HPC's <br />concerns were implicit and did not require specific language be included as <br />she had suggested. Her intention was now to propose language to attach at the <br />end of the amendment reiterating that this new section does not supersede the <br />requirements of the HPC. In discussion of the means to document the <br />commission's concerns, Mr. Oxian suggested that a letter be -submitted for the <br />record. Mrs. DeRose indicated that she intended to cover the issues with a <br />letter. <br />Mrs. DeRose also indicated that she had sent a letter to the consultant on the <br />Economic study requiring completion of the work. Mr. Duvall stated that as of <br />this date the document had not been submitted. <br />She also noted that she had sent a letter to Dr. Lackman of 1414 East Wayne <br />Street to which she had received both telephone and written response <br />indicating that she did not intend to comply with the HPC's request to remove <br />her fence constructed without- COA and that she had retained counsel to fight <br />efforts to require her compliance with the District standards. Mrs. DeRose <br />indicated further that it is her impression that Dr. Lackman is attempting to <br />organize neighbors to remove the historic designation from the East Wayne <br />neighborhood. <br />Mr. Talley inquired about what action the Building Department may have taken <br />regarding this issue. Mr. Duvall indicated that he had not heard of any <br />activity on their part. Mr. Oxian indicated that in discussions which he had <br />with East Wayne residents, he had not found antipathy to the historic <br />designation. Mrs. DeRose responded that though this may be true she has found <br />that there appears to be a public relations problem with at least some <br />. constituents in the district in that many view the commission as a hindrance <br />rather than a resource. Mrs. Hostetler recalled that the permit irregularities <br />with the activities at this property were extensive. Mr. Duvall noted that the <br />Buildings Department had actively pursued the contractors who had been <br />negligent regarding their permits at this location. <br />Mrs. Choitz suggested further correspondence to reiterate the commission's <br />position. Mrs. DeRose indicated that this should not be required and that if <br />
