• the commission pursues a cease & desist order, Dr. Lackman will not only have <br />difficulty demonstrating that the commission acted arbitrarily or <br />capriciously, but also that she exhausted her administrative remedies. She <br />concluded that she was not concerned with the strength of the record or the <br />commission's case but did have concerns about the time and public relations <br />difficulties which accompany such a suit. <br />Fr. Bullene indicated that this concern could offer the opportunity to <br />demonstrate to the neighborhood the importance and value of the designation. <br />Mrs. Choitz recalled that there had been some animosity to designation at the <br />time that the district was established, but, that she found that the opposition <br />was not deep or extensive. She did observe that there had been considerable <br />turnover of the properties since that time and emphasized the importance of <br />maintaining current information on property ownership. <br />Mr. Fine asked Mrs. DeRoso if she thought Dr. Lackman would be agreeable to a <br />meeting with commission members to discuss the 'issue. Mrs. DeRose stated that <br />her impression was that Dr. Lackman was primarily interested in deregulating <br />the district at this time and that good public relations with other residents <br />would be the most effective response on the part of the commission. She noted <br />that one of Dr. Lackman's principal objections is that she was poorly informed <br />from the outset as to the requirements of the district. She further indicated <br />that this is principally due to the failure of the Liaison CommiVtee to <br />maintain its necessary activities. <br />Mr. Duvall indicated that one issue which had arisen was whether the five <br />year review of standards which is allowed for in the guidelines had ever <br />occurred. Mrs. Choitz indicated that an attempt had been made at the five year <br />• point and that there had been a consensus at that time that it was not <br />necessary, and the commission had not pressed for such a meeting. Mr. Oxian <br />indicated that in a similar instance at Lincolnway East LHD, the council <br />inquired as to whether a review had been requested, and finding that there had <br />been no request, dispensed with the issue. Mr. Talley stated that he agreed <br />with counsel that in the press the commission would appear badly in a case <br />such as this, whereas the reality is that the standards belong to the <br />neighborhood. 'Mr. Oxian indicated that he felt the commission should wait to <br />see if Dr. Lackman actually sought legal representation. <br />Mr. Talley stated that he felt the commission to be lax in reinforcing the <br />sense of the special value of the historic districts while alienating <br />residents with the brusque enforcement of standards. Mrs. Choitz indicated <br />agreement with this point and proposed that it was necessary to organize <br />regarding the proper maintenance and scheduling of Liaison activities. <br />Mr. Oxian stated that he felt that individuals left the liaison offices due to <br />a sense Liaison membership puts one in the role of an informer against one's <br />neighbors. He stated that when individuals complain about the relationship of <br />the commission with the neighborhood(s), that they should be encouraged to <br />assume liaison duties. Mrs. Choitz pointed out that there were prescribed <br />procedures for establishing the Liaison officers and that the procedures <br />needed to be orderly and uniform. Mr. Oxian reminded her that she was the <br />chair of the Districts Committee and that it was her responsibility to <br />mobilize procedures for maintaining the Liaison Committees. <br />Mrs. Choitz reminded him that these public activities would require greater <br />financial resources than those required for the Landmarks Committee. Mr. <br />Duvall reminded the commission that it does at this time -have some extensive <br />• financial resources due to the late appropriation of our CDBG funding and that <br />some of this could be applied to the necessary mailings. Mrs. Choitz indicated <br />that these activities need to be ongoing and shouldn't be dependent on <br />short—term devices. <br />Mr. Talley asked what might be the turn—key to get started on rehabilitating <br />the neighborhood relations.
