3) Thank you note from Christine Anderson for wedding gift. <br />4) National Trust compensation and computer study. <br />5) Note from Paul ;;crlinn of the City of South Bend Parks & Recreation <br />Department indicating that the East Race Area has been accepted for <br />participation in the D.O.0 / National Trust Hoosier Heritage Development (HIID) <br />Program for the Spring of 1996. <br />Outgoing Correspondence: <br />1) Registration for Msrs. Duvall and Oxian for the Cornelius O'brien Lectures <br />in Fort Wayne, Sept. 29-30. <br />2) The letter has been prepared.for sending the historic Preservation Plan to <br />The County Council for its adoption. <br />D. Legal <br />a. amendment to state statute <br />Mrs. DeRose reviewed her memo regarding the amendment to State Statute which <br />she has prepared which would permit the Historic Preservation Commission to <br />introduce an amendment to the local zoning ordinance establishing a local <br />historic district. Mr. Oxian indicated that he had not seen the memo. Mr. <br />Duvall indicated that he had received the memo and placed it in Mr. Oxian's <br />mail tray in the office. This is essentially and exception as St. Joseph <br />County is the only jurisdiction in the state wherein the historic preservation <br />powers reside in the zoning chapter of the code. <br />b. Rules and By -Laws <br />Mrs. DeRose then raised the issue of the proposed procedural rules which had <br />been discussed at the June meeting of the IIPC and the interface of those <br />rules with the existing by-laws. Mr. Oxian determined to form a special <br />committee to review the two and propose a resolution of the two. Mr. Talley <br />brought up the concern for conflict of interest which had been discussed in <br />June and mentioned the applicability of state law. Mrs. DeRose indicated that <br />she concurred on the importance of establishing this rule. Mr. Talley <br />continued with an inquiry regarding the liability of commission members with <br />regard to the actions of the commission. Mrs. DeRose explained that <br />technically commission members bear liability but that the City insures <br />citizens acting in its behalf. The requirement for public notice of meetings <br />of the commission was raised. Mrs. DeRose indicated that five days advance <br />notice was the requirement. Lir. Oxian indicated that he thought that the legal <br />memo regarding -liability should be included in the compilation being prepared <br />by Mrs. DeRose. <br />Mr. Oxian appointed himself, Mrs. Iiostetler and Mrs. Choitz to the special <br />committee to make recommendation for the resolution of the proposed rules and <br />the by-laws. Ile asked other commission members to review the proposals and <br />contact those appointees with their suggestions for this work. <br />There was brief discussion regarding a loose-leaf binder format for the rules, <br />By -Laws, etc. to allow easy updating. <br />3. Historic Districts <br />��r. Oxian reported that the Lincolnway West Business Association had <br />distributed the petition materials for the proposed Local Historic District <br />and reviewed their proposal to collect signatures from the largest property <br />holders first followed by individual home and business owners. <br />4.
