Commissioner Eide then made a statement that the reason for referring the <br />application for 1130 East Jefferson was for clarification of the detail where <br />the southeast corner of the new roofline meets the garage. <br />4. Historic Districts <br />Mr. Duvall stated that there had not been a meeting of the committee to <br />discuss the Lincolnway West potential local Historic District. President <br />Oxian observed that the (Lincolnway West) board (of directors) had not met <br />either. Commissioner Choitz observed that there needed to be a meeting of the <br />committee of the whole to review the options which have been outlined by the <br />director before a general public meeting should be held. The steering <br />committee makeup could require change depending on what areas are to be <br />included, the main options being Lincolnway frontage only, the possibility of <br />segmentation into more than one district. President Oxian indicated that the <br />preliminary documents should be circulated to the members of the Historic <br />Districts Committee prior to meeting. <br />Mrs. DeRose then addressed the issue of the chronology of adopting standards <br />and guidelines with relation to the designation of districts. This was one of <br />the main issues in the Laskowski appeal. She made the directive that it be <br />made clear to all property owners within future new districts that until <br />specific standards and guidelines have been established for a district, the <br />model guidelines will apply and that Certificates of Appropriateness are <br />required from the moment that a new district is created. Commissioner Choitz <br />indicated that she understood "that magic moment" to be when the HPC made its <br />recommendation. Mrs. DeRose corrected that the HPC authority in a new district <br />would commence when the Common Council adopts the ordinance creating the <br />district. <br />President Oxian clarified that before River Bend the Standards and Guidelines <br />had always been approved prior to the ordinance and that in the case of River <br />Bend, the Standards and Guidelines had not yet been adopted at the time that <br />the common Council approved the ordinance due to the requirement of the <br />amended enabling ordinance which required recommendation from the HPC within <br />90 days. Mrs. DeRose observed that it was this discrepancy which led in part <br />to the success of Mr.Laskowski's appeal wherein he was able to represent that <br />his understanding was that there were not yet standards. Mrs. DeRose <br />reiterated that in future new districts that until specific standards and <br />guidelines have been established for a district, the model guidelines will <br />need to be made to apply and that Certificates of Appropriateness are to be <br />required from the moment that a new district is created. In the Laskowski <br />situation the problem was compounded by a letter from former director Fred <br />Holycross to the applicant in which he failed to adequately assert the <br />authority of the commission. <br />5. Historic Landmarks <br />a. First reading on landmark status for the following properties: <br />1601 Kemble Avenue (Toth State Bank) <br />534 LaPorte Avenue (Starzynski Texaco Gasoline Station) <br />b. President Oxian inquired whether the former Administrative assistant, Chip <br />Frederick had forwarded the recommendation of the Commission to landmark the <br />lamp post at the corner of Niles and Leeper. Mr. Duvall indicated that he did <br />not Know. President Oxian instructed Staff to proceed with this activity. <br />
