Maintenance Committee and that the committee should meet with the contractor
to resolve the details of concern. The motion was seconded by Commissioner
Choitz. Legal
Mrs. Derose reported of the City of South Bend Common Council's hearing of Mr..
Dennis Laskowski's appeal of those aspects of his application for COA
(1994-06-23-2) which were denied by the commission. She indicated that in her
opinion the Council's decision was incorrect but that it is not in the best
interest of the commission to pursue appeal.
From this occasion she has concluded that the commission needs to be more
careful in the wording of motions for denial to include in such motions the
reason(s) for the denial in the record. She further stated that the situation
which caused this appeal were somewhat unique, having to do with the delay in
establishing the design guidelines after the designation of the River Bend LHD
and specifically being based in the letter of Fred Holycross (former Director
of the HPC) which sought to persuade the property owner to apply for a COA
rather than requiring that he do so. John Oxian observed that he, Commissioner
Hostetler, and Mr. Duvall spoke at the meeting of the Common Council and that
the hearing of the appeal took approximately two hour. Commissioner Choitz
inquired as to whether the same standard of presenting reasons should be
applied to the assigning of applications to committee. Mrs. DeRose responded
in the affirmative.
