The motion was approved unanimouslv. <br />IV. Regular Business <br />A. Approval of Minutes - July 18, 1994 <br />Commissioner Petrass moved that the minutes from the July meeting be approved <br />as written. Commissioner Choitz seconded the motion. The minutes were approved <br />unanimously. <br />B. Treasurer's Report <br />There was no report from the Treasurer. <br />C. Correspondence <br />Mr. Duvall Made the Commission aware of the following items of interest which <br />have been received: <br />1. New Brochure from the National Park Service - "My Property is important to <br />the Nations Heritage - What does that mean ?" <br />2. Solicitation for "Main- Street Awards" from the Indiana Dept. of Commerce. <br />Nominations are due by Sept. 1. <br />3. Notice of "Indiana Main Street Conference" September. 21, 22, & 23 in <br />Elkhart. <br />4. Notice of DNR -Division of Historic Preservation & Archaeology winter <br />internships. <br />5. Notice of Affordable Housing Forum, Friday August19 sponsored by the South <br />Bend & St. Joseph Co. Housing Consortium. <br />6. Notice of Southhold's new Office location 516 South Street. <br />D. Committee Reports <br />1. Budget & Finance <br />No report. <br />2. Legal <br />Mrs. Derose reported of the City of South Bend Common Council's hearing of Mr.. <br />Dennis Laskowski's appeal of those aspects of his application for COA <br />(1994-06-23-2) which were denied by the commission. She indicated that in her <br />opinion the Council's decision was incorrect but that it is not in the best <br />interest of the commission to pursue appeal. <br />From this occasion she has concluded that the commission needs to be more <br />careful in the wording of motions for denial to include in such motions the <br />reason(s) for the denial in the record. She further stated that the situation <br />which caused this appeal were somewhat unique, having to do with the delay in <br />establishing the design guidelines after the designation of the River Bend LHD <br />and specifically being based in the letter of Fred Holycross (former Director <br />of the HPC) which sought to persuade the property owner to apply for a COA <br />rather than requiring that he do so. John Oxian observed that he, Commissioner <br />Hostetler, and Mr. Duvall spoke at the meeting of the Common Council and that <br />the hearing of the appeal took approximately two hour. Commissioner Choitz <br />inquired as to whether the same standard of presenting reasons should be <br />applied to the assigning of applications to committee. Mrs. DeRose responded <br />in the affirmative. <br />
