President Oxian explained that because Dr. Klopfer had not come up with a <br />restoration plan, the Committee had created a plan for his property, and that <br />after having received Dr. Klopfer's letter requesting a continuance, the <br />Commission could send him tentative approval of the plan which he will have a <br />month to consider and that he must be in attendance at the next Commission <br />meeting so that the Commission can come to a final decision. <br />Mr. Greta noted that any incentive or pressure that could be put on Dr. <br />Klopfer would be a benefit to the neighborhood. Commissioner Sporleder <br />inquired if Mr. Greta thought Dr. Klopfer needed help in finding a proper <br />contractor. Mr. Greta stated Dr. Klopfer may need guidance in that respect <br />also. Mr. Greta also noted that Dr. Klopfer was interested in securing the <br />property against vagrants and things of that nature by putting up a gate, but <br />that Dr. Klopfer might not know how to do these things. Ms. Marsha Stevenson <br />noted Dr. Klopfer has cut back the plantings around the house so that the <br />windows are exposed. President Oxian called for a vote and the motion passed <br />unanimously. President Oxian moved that the approval. be tabled for one month <br />that : Dr. Klopfer will be in attendance at the next <br />meeting of the Commission and that there will no longer be any delays. <br />Commissioner Hostetler seconded the motion., Kathy Dempsey (code enforcement) <br />presented the Commission with a police report stating three juveniles had <br />broken into the building September 11, 1994. The juveniles were apprehended <br />and the fire department was called to extinguish material left burning inside <br />the house. Ms. Dempsey assured Mr. Greta that she appreciated that he had <br />conversed with Dr. Klopfer, but that there has been a code enforcement file <br />open on the property since 1987 and no work has been done. Ms. Dempsey stated <br />that Code Enforcement has had to secure the building, mow the lawn, and file <br />with collection agencies to get the bills paid on the property. Ms. Dempsey <br />indicated that she hoped that Dr. Klopfer was going to take action on <br />restoring the property, but she did not see that there was any concrete <br />evidence that Dr. Klopfer was moving ahead toward restoration. Ms. Dempsey <br />made clear she fears the neglect of this property will lead to a tragedy <br />involving children or Dr. Klopfers neighbors. <br />Commissioner Sporleder asked if President Oxian's motion was approved and the <br />Commission had already approved the Scope of Work, if Dr. Klopfer applied for <br />a Certificate of Appropriateness that followed the Scope of Work prepared by <br />the Commission, could he begin on the work? Mr. Duvall clarified the question <br />that if Dr.•Klopfer applied for a Certificate of Appropriateness for the Scope <br />of Work outlined and approved by the Commission, could the application be <br />approved as a Staff Approval. Legal Counsel DeRose advised the application <br />could be approved as a Staff Approval since the Commission had already <br />approved the work. Mr. Duvall questioned what status that put the Certificate <br />of Appropriateness in. Legal Counsel DeRose stated that if Dr, klopfer signed <br />his agreement to the Scope of Work, that would complete the Certificate of <br />Appropriateness and it would be approved with the Scope of Work as outlined. <br />Ms. DeRose added if Dr. Klopfer does not approve the Scope of Work, then the <br />Commission will hear the case at the next meeting. Commission Choitz added the <br />90 days would run from the time the Certificate of Appropriateness was issued. <br />Legal Counsel DeRose suggested Mr. Duvall's correspondence with Dr. Klopfer <br />make the options clear to Dr. Klopfer and also advise him of the break-in at <br />the property. Commissioner Choitz requested that Legal Counsel DeRose make <br />sure everything she knew needed to be dealt with was contained in the letter <br />to Dr. Klopfer and that Mr. Duvall send the letter certified so that the <br />Commission has record that the letter was received.
