Sporleder asked about the landscaping element of the C of A. <br />n Commissioner Oxian clarified the motion. <br />5. 344 South Sunnyside -- EW-LHD <br />Mr. Frederick read the staff report. Commissioner Sporleder asked if <br />the C of A applied to the kennel and the landscaping. Staff confirmed <br />that it did. Commissioner Oxian asked who brought the application. <br />Mr. Frederick explained the circumstances and informed the HPC that <br />the homeowner had filed the application following construction of the <br />kennel. Commissioner Oxian asked that Counsel send a letter of warning <br />to the applicant. Commissioner Oxian moved to approve the kennel but <br />request that the shrubbery be trimmed appropriately or removed. Commissioner <br />Sporleder seconded the motion. Counsel then asked for guidance as regarded <br />the letter. Commissioner Choitz stated that the Standards do not address <br />the trimming of shrubbery. Commissioner Oxian then asked that the shrubbery <br />be removed. Commissioner Sporleder withdrew her second of Commissioner <br />Oxian's motion. Discussion ensued. Commissioner Choitz moved to approve <br />the application as submitted (construction of kennel and landscaping) <br />and send a letter from counsel to applicant informing the homeowner of <br />their obligations inside a Local Historic District. Commissioner Eide <br />seconded the motion. The motion passed unanimously. <br />IV. Regular Business <br />A. Approval of Minutes -- March 21, 1994 <br />Commissioner Choitz moved to approve the minutes as submitted. Commissioner <br />Petrass seconded. Motion passed unanimously. <br />B. C of A Staff Approvals <br />A. 1029 East Wayne -- Local Landmark; in-kind replacement of gutter <br />section <br />B. 1027 East Wayne -- Local Landmark; in-kind replacement of chimney <br />cap <br />C. 231 South Eddy -- Local Landmark; in-kind replacement of gutter <br />section <br />2. Budget and Finance -- No report <br />3. Legal <br />Counsel asked that the HPC vote to grant its authority to hire <br />Staff person. Discussion ensued. Commissioner Sporleder asked <br />who was the current employer of record. Counsel replied that the <br />county was the employer of the director. Commissioner Wiener asked <br />if the HPC could have an employer id. number. Counsel replied in <br />the affirmative. Commissioner Oxian stated that the county was the <br />employer because the county passed the HPC ordinance prior to -the <br />city's passage of same. The motion was made, seconded and passed <br />unanimously. Counsel reviewed concerns of Code Enforcement about <br />the demolition delay in our ordinance. <br />4. Historic Districts <br />Commissioner Oxian requested an HDC meeting. Commissioner Choitz <br />was asked to schedule the meeting. <br />5. Historic Landmarks <br />A. Commissioner Oxian noted the progress of the Penn Township Pioneer <br />Cemeteries ordinances. <br />B. First reading for 221 N. Michigan, 237 N. Michigan and 3418 Mishawaka <br />Avenue as Local Landmarks. <br />
