Sporleder asked about the landscaping element of the C of A. n Commissioner Oxian clarified the motion. 5. 344 South Sunnyside -- EW-LHD Mr. Frederick read the staff report. Commissioner Sporleder asked if the C of A applied to the kennel and the landscaping. Staff confirmed that it did. Commissioner Oxian asked who brought the application. Mr. Frederick explained the circumstances and informed the HPC that the homeowner had filed the application following construction of the kennel. Commissioner Oxian asked that Counsel send a letter of warning to the applicant. Commissioner Oxian moved to approve the kennel but request that the shrubbery be trimmed appropriately or removed. Commissioner Sporleder seconded the motion. Counsel then asked for guidance as regarded the letter. Commissioner Choitz stated that the Standards do not address the trimming of shrubbery. Commissioner Oxian then asked that the shrubbery be removed. Commissioner Sporleder withdrew her second of Commissioner Oxian's motion. Discussion ensued. Commissioner Choitz moved to approve the application as submitted (construction of kennel and landscaping) and send a letter from counsel to applicant informing the homeowner of their obligations inside a Local Historic District. Commissioner Eide seconded the motion. The motion passed unanimously. IV. Regular Business A. Approval of Minutes -- March 21, 1994 Commissioner Choitz moved to approve the minutes as submitted. Commissioner Petrass seconded. Motion passed unanimously. B. Treasurer's Report -- No report C. Correspondence -- No report D. Committee Reports 1. C of A Staff Approvals A. 1029 East Wayne -- Local Landmark; in-kind replacement of gutter section B. 1027 East Wayne -- Local Landmark; in-kind replacement of chimney cap C. 231 South Eddy -- Local Landmark; in-kind replacement of gutter section 2. Budget and Finance -- No report 3. Legal Counsel asked that the HPC vote to grant its authority to hire Staff person. Discussion ensued. Commissioner Sporleder asked who was the current employer of record. Counsel replied that the county was the employer of the director. Commissioner Wiener asked if the HPC could have an employer id. number. Counsel replied in the affirmative. Commissioner Oxian stated that the county was the employer because the county passed the HPC ordinance prior to -the city's passage of same. The motion was made, seconded and passed unanimously. Counsel reviewed concerns of Code Enforcement about the demolition delay in our ordinance. 4. Historic Districts Commissioner Oxian requested an HDC meeting. Commissioner Choitz was asked to schedule the meeting. 5. Historic Landmarks A. Commissioner Oxian noted the progress of the Penn Township Pioneer Cemeteries ordinances. B. First reading for 221 N. Michigan, 237 N. Michigan and 3418 Mishawaka Avenue as Local Landmarks.
