AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING ORDINANCE NO. 4990-68, AS AMENDED, BY THE ESTABLISHMENT OF THE NEAR NORTHWEST NEIGHBORHOOD HISTORIC PRESERVATION DISTRICT. Pursuant to Indiana Code Section 36-7-11-7, proposed boundaries of historic preservation districts must be approved by an appropriate ordinance of the Common Council. Pursuant to Section 21-117.2 of the Municipal Code of the City of South Bend, a petition to designate on Historic Preservation District may be initiated by a petition signed by owners of fifty percent (50%) or more of the subject area. This Ordinance is filed along with a five-page Petition requesting that the Historic Preservation District be established. Pursuant to local regulations, the Ordinance would be sent first to the Historic Preservation Commission for proper public hearing and recommendation, then to the Area Plan Commission for review, public hearing, and recommendation, and then to the Common Council for final disposition. It is believed that by the establishment of the Near Northwest Neighborhood Historic Preservation District, that the historical, cultural and educational values of this area would be significant and suitable for preservation. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: Section 1. Ordinance No. 4990-68, as amended, which Ordinance is commonly known as the Zoning Ordinance of the City of South Bend, Indiana, is amended in order that the zoning classification of the following described real estate in the City of South Bend, St. Joseph County, State of Indiana: Bounded on the west by the alley between Sherman Ave. and Harrison Street, on the north by California Ave., on the east by Portage Ave., and on the south by properties up to, but not including those situated on Lincolnway West. BE AND THE SAME IS HEREBY established as an Historic Preservation District with such uses as permitted in Section 21-36.1 of the Municipal Code of the City of South Bend, Indiana, and shall be designated as the Near Northwest Neighborhood Historic Preservation District." A copy of a petition in support of the designation is marked "Exhibit A", and is attached hereto and incorporated herein by reference. Section II. The Historic Preservation Commission of South Bend and St. Joseph County shall adopt guidelines for the Near Northwest Neighborhood Historic Preservation District. Section III.
