October lq, 1981 <br />page 4 <br />Butler and Mr. John Bodine for their opinions. Mr. Butler <br />approved the policy and Mr. Bodine has not yet responded. <br />d, Legal <br />(1) New Attorney <br />Mr. Nimtz stated that he spoke to Kevin Butler about the <br />possibility of his being the Historic Preservation Commission's <br />lawyer, although no fee was discussed. Mr. Butler told Mr. Nimtz <br />that if the position was offered to him he would accept it. <br />Mr. Nlmtz moved that the position be offered to Kevin Butler, <br />Mrs. Price seconded, and the motion carried. Mrs. Price suggested <br />that the letter, drafted by the Commission's former attorney, <br />Mr. Gaylen Allsop, on how the Commission attorney will work with <br />the Commission, be taken to Mr. Butler. <br />(2) Draft of Ordinances <br />Mr. Oxian read the proposed changes in the Ordinance. Mrs. Price <br />suggested that Sec. 21-117.1 parts k & l be clarified as to which <br />council's approval is necessary when funds are received. <br />Mr. Nimtz moved that the Revisions be put into Amendment form <br />for the Councils' consideration, Mr. Oxian seconded, the motion <br />carried. Mrs. Price suggested that she and Mr. Ox/an appear <br />jointly <br />(3) Procedures for Public Hearing & Implementation Plan <br />Mrs, Price stated that Mr, Uxian is working on the Procedures <br />for Public Hearings and she is putting together the Implementation <br />Procedures. Both reports will be presented to the Legal Committee <br />and the Commission attorney on completion. Mrs. Price suggested <br />that it is the Commission's duty to survey, develop a plan from <br />the results of the survey, and then come up with a Preservation <br />Plan. She felt the Commission should prepare a list of local <br />government agencies involved and begin to ask for tha}r.Anput <br />into a Procedures Plan. <br />(4) Certification of Ordinance <br />Ms. K)emnac reported that both the city and state ordinance had <br />been certified and that the only application was with the tax act. <br />Mrs. Sporledar questioned whether the Commission might want to <br />certify our local districts to make the tax act available to <br />owners, Mr. Nin¢z asked how long the process of certifying a <br />district would take. Mrs. Price explained that the National <br />Register Regulations are not yet out and there is a hold on all <br />private building nominations. <br />\ <br />
