November 17, 1980 <br />Page 4 <br />STAFF REPORT (cont.) <br />A decision was made to order the following three books on a 15 -day <br />trial. <br />1) How to Recycle Old Buildings <br />2) Rehabilitating for Profit <br />3) Diagnosing and Repairing House Structure Problems <br />7. Old Business <br />No Report <br />8. New Business <br />Ted Wasielewski presented a letter from 720 Colfax Ave. requesting <br />that the Commission consider a donation of a facade easement from <br />the residents -Then Mr. Wasielewski said the Commission should work <br />with the Bauer's on this request. <br />Mr. Oxian stated that there are now three such requests before the <br />Commission and that as we proceed we need to explore the different ways <br />of accepting the easement. First, is to make the structure a landmark <br />then accept the easement and try to get a reduction in the property tax. <br />Second, we could accept the easement without the house having land- <br />mark status. Mr Oxian stated that Attorney, Gaylen Allsop, advised him <br />to wait until he finishes his review of the ordinance before making <br />the house at 720 Colfax a landmark. <br />Mr. Hayes raised the point that several agencies are able to accept <br />easements. Mrs. Price confirmed this and stated that any non-profit <br />organization can accept an easement and the owner is eligible for a tax <br />break on his property taxes. In addition, if the easement is in <br />perpetuity, the owner can receive a gift tax reduction on his Federal <br />income taxes. <br />Mr. Hayes stated that the Commission should look at all available options. <br />Mr. Oxian and Mrs. Price stated that the Commission has already done <br />a considerable amount of research on this matter. <br />Mr. Hayes asked if it is possible for the organization holding the <br />easement to maintain the facade and let the property owner donate a <br />certain sum of money each year to the organization for that purpose and <br />then get an added gift tax reduction. Mr. Oxian replied that this is a <br />question that needs further study. He went on to say that as our <br />ordinance is today, we cannot accept the easement, or any other donations <br />for that matter. <br />• <br />
