March 9, 1976 <br />Page 3 <br />Legal Committee <br />Mr. Nimtz reported that the Commission's amendment to its <br />ordinance is still with the Area Plan Commission. Mr. Oxian <br />then remarked that the delay has been long enough and that <br />the amendment should simply be taken to the Common Council. <br />Mr. Nimtz felt it would be unwise to bypass the Area Plan <br />Commission. In the discussion which ensued it was pointed <br />out that Mr. Parent said that no single ordinance would be <br />acted upon until the entire zoning ordinance is considered. <br />Mr. Smith suggested that the Commission talk to Mr. Johnson <br />and to Mrs. Judy Studer about this matter. Mr. Oxian made a <br />motion -to take this ordinance out of the Area Plan Commission <br />and submit it directly to the Common Council. Mr. Wasielewski <br />seconded this motion. It was put to a vote and Ms. Davission, <br />Mr. Nimtz and Mrs. Sporleder voted nay. The motion was thereby <br />defeated. Mr. Nimtz then moved that John Oxian be authorized <br />to hold discussion with the Area Plan Commission and the Common <br />Council relative to the amendment proposed to the Commission's <br />ordinance and to ascertain the feasibility or possibility of <br />passage (of the amendment to said ordinance) and if said or - <br />dinance is not agreeable to the Council or the Area Plan Com- <br />mission what their desires are. Mrs. Sporleder seconded this <br />motion and it passed unanimously. <br />Mr. Nimtz then read a letter from J. Reid Williamson regarding <br />tax deductions for historic homes. This includes a charitable <br />deduction for the donation of a facade easement and then a <br />yearly property tax deduction. Mr. Ri_nderle mentioned that the <br />Commission would have to find out how the value of such ease- <br />ment is determined. Mr. Smith gave examples of how the program <br />worked elsewhere and a discussion followed on this matter. <br />Public Relations and Community Education <br />Ms. Davisson said she had met with Mr. Rinderle and Mrs. Gil- <br />bert regarding some of the activities of this Committee. She <br />mentioned that there is an -easel displaying an historic home <br />in the lobby of the County -City building through February and <br />March. <br />A letter to the owners of superior homes was to be sent as a <br />publicity measure, as well as a form letter to all realtors and <br />brokers. These letters were read and the Commission made re- <br />visions. <br />Ms. Davisson also outlined plans for a package presentation <br />to schools and teachers about historic homes. This would be <br />set up for July, possibly for use in the Fall semester. <br />Ms. Davisson next informed the Commission that a letter offer- <br />ing assistance to outlying towns to conduct surveys of historic <br />homes would be drafted and sent. It was suggested that the new <br />Historic Commission in Elkhart be contacted. <br />
