The employee shall pass a drug test administered under tnls <br />specification at the employee's expense <br />6.8.7. A second violation (2°d Offense) of the prohibitions set forth in this policy will <br />result in the following protocols: <br />6.8.7.1. Minimum of (6) six month suspension for all work within the Company <br />from the date of D&A Test <br />6.8.7.2. The employee shall complete an appropriate rehabilitation program <br />satisfactory to the Company at the employee's expense. <br />6.8.7.3. The rehabilitation program must be completed before the employee is <br />permitted to return to work, even if suspension time has been <br />completed. <br />6.8.7.4. The Medical Review Officer (MRO) has determined that the Company <br />employee is fit to return to duty. <br />6.8.7.5. The employee shall pass a drug test administered under this <br />specification at the employee's expense <br />6.8.8. Any additional violations beyond a second offense will be ground for immediate <br />termination which will prohibit the employee from returning to work within the <br />Company. <br />6.8.9. NOTE: The DISA drug and alcohol program is a third party administrator which <br />the Company utilizes for specific customers across the United States. If an <br />employee is identified as having an issue within this program, the employee will <br />be held to the Company's Drug and Alcohol program in addition to the <br />proposed corrective actions stipulated by the DISA program. <br />6.9. Alcohol Impairment: <br />6.9.1. Employees participating in Random, Post -Accident, Reasonable Suspicion, <br />Return -to -Duty, or Follow-up Testing and are found to have a breath alcohol <br />test greater than 0.00 but less than 0.04 are considered to have alcohol <br />impairment and will removed from (all) work activities for the remainder of the <br />workday. The identified employee shall report for complete follow-up testing at <br />the next scheduled work shift or 24 hours after the test, whichever is greater, <br />before they are permitted back to work. <br />6.9.2. With the exception of a removal from work activities or company vehicle <br />operation, the Company will not enforce the requirements as outlined in the <br />(Management Actions & Sanctions Section) against an employee with regard to <br />an alcohol test result that is greater than 0.00 but less than 0.04. However, this <br />does not prohibit the Company from taking action that is consistent with <br />existing law, and/or the Corporate Safety Manual. <br />6.10.
