OBSERVEM IZE"llURN-TO-DUTYTESTING <br />The Return to Duty test is required for an Employee to be <br />reinstated into the BCRC program following a positive test, <br />missed random, walkout, or refusal to submit as described in this <br />BCRC Policy. Tie participant must have a negative drug test <br />before resuming performance of his/ber job duties.'fliis test may <br />not be taken until. the Counselor has set a date for the test. The <br />specimen for all Rewrn, to Duty Tests shall be given pursuant to <br />observed collection protocol and procedures. <br />I I'll IJIMI <br />Follow-up testing for drugs and/or alcohol is a requirement in <br />order for a returning Employee to stay in compliance with the <br />BCRC Program. Iesting shall be determined by the Employee <br />Assistance Counselor, and will be implemented and monitored by <br />the TPA (BCRC) when the Employee returns to work. Follow-up <br />tests must be taken within forty-eight (48) hours from the time <br />when the TPA attempts to contact or contacts the Employee, or <br />the Employee will be considered non -compliant, made "NIX, and <br />returned to the EA.P for further evaluation. <br />A New employee/.Applicant whose initial, drug or alcohol test is <br />confirmed as a Positive Test shall pay all costs for such fiffloW-Up <br />testing required by the EAP and any subsequent testing required <br />by the EAR The specimen for all Follow -Up Testing shall be <br />given pursuant to observed collection protocol and procedures. <br />Fff WIMMUM <br />An Employee who disputes non -negative (positive) results shall <br />have the right to have his/her initial sample independently <br />re -tested by a Department of Health and Human Services (HHS) <br />certified laboratory of his/her choice, at his/her own expense only <br />39 <br />
