'The BCI C will then generate a random <br />selection of the submitted pool and return the selections to tll:e <br />appropriate party: "ll-u.i.s random may be done on a monthly basis. <br />These On -Site Random Selections shall include only those <br />Employees submitted. <br />Any confirmed noji-negative positive test at these facilities <br />will require an EAP evaluation prior to returning to work. Ille <br />testing will be consistent with the Addendurn contained herein as <br />Attachment III. <br />PROBABLE CAUSE TESTING <br />An Employee may be subject to Probable Cause Testing based <br />on observed and documented unusual behavior. Circumstances <br />sufficient to lead a reasonable person to suspect that an Employee: <br />is under the influence of drugs or alcohol, or is in possession of; a <br />controlled substance shall be determined by animmediate <br />supervisor and should be confirmed by one other supervisor <br />whenever possible. rllie immediate supervisor shall document, in <br />writing, the incident and the probable cause basis for such testing. <br />Jbe documentation shall specifically detail th.e behavior and <br />conduct of the Employee, the location, date, time, of <br />observation, conversations, witnesses (if" any), and should be <br />signed by the supervisor who witnessed the incident. Such <br />Employees may request that a Union representative be available <br />or present prior to any action taken by an Employer, if any, at any <br />stage of the policy and its administration. By referring an Employee for Probable Cause <br />Testing, the Employer represents to BCrC that the Employer <br />has complied with these policies and procedures and any other <br />policies and procedures required by law. BCRC has no obligation <br />to determine or confirm that that Employer has complied with <br />such policies and procedures. <br />M <br />
