NEW <br />BUSINESS (Cont'd <br />Further, Mr. Soltesz said, "As we are talking about 'workmanlike <br />manner' I would hope that Mr. Simonds would want again to re- <br />create the aesthetics, because we are talking about workmanlike <br />procedures or sawcutting out--something I am familiar with - -if <br />that takes away from the aesthetics that were planned by the <br />designers, I would hope they would replace that same theme on <br />aesthetics that was displayed here when the program was sold to <br />us here in the City. <br />The question on the proper procedure to take, requested by the <br />Chair, Commissioner Wiggins responded, "Mr. Oesterling here <br />stated to us their concern about a problem and the approach they <br />had to it. It is largely informational, at this point, and I <br />would suggest, because as of right now, I don't agree to the <br />proposal that has been made. I don't think it will answer the <br />problem, and I would suggest, at least, that they go back and <br />take another look at it, and tell us- -after you look again - -if <br />this is still what ought to be done. You are kind of treading <br />on razor edge here, because to one degree you are our expertise, <br />a person who is representing.us and'our interest, and at the same <br />time you are also involved. Being a man of some stature, I <br />believe you can handle it." Mr. Oesterling said they are involved <br />to the extent that Clyde E. Williams as the joint venturer is <br />involved to the extent of being responsible to the approval of <br />their recommendations to the Commission, for the approval of <br />correction methods. They tend to think the company is responsible <br />and the contractor has a contract and they guarantee their work. <br />Commissioner Wiggins said he agrees, "but that somebody had to agree <br />that that method was acceptable. It didn't work to the extent that <br />we have the problem that is highly visible and exists, and if every- <br />thing worked right, it wouldn't be there. Those are things we can't <br />avoid. So what we want to do now is to make sure we remedy the de- <br />fect and that we don't create three more problems with the solution <br />to the one problem." Mr. Oesterling agreed that is true, but, of <br />course, the maintenance agreement will continue on, even with the <br />repair. It wasn't satisfactory to begin with. It will still be <br />under warranty, under our agreement, but that we don't want that <br />to happen. <br />BUSINESS <br />a.
