5. OLD <br />BUSINESS (Cont'd <br />there, and so the situation rests now that if the contingency <br />amendment is not rescinded, the firm will pick up the benches <br />next week. Mr. Simpson said he was making a last minute appeal <br />to the Commission, as it would be nice to have those benches <br />there. As a matter of fact, he said he is concerned more about <br />the other benches on the Plaza- -the built-in ones are in very bad <br />shape. They have been getting phone calls from the Mayor's Action <br />Line that the people are getting splinters in their hands. He <br />has talked to Mr. Farrand about these and we will have to refinish <br />the benches that are built in. They are in bad shape. <br />Mr. Bill Slabaugh, Dept. of Public Works, said those benches are <br />under warranty. We have a three -year guarantee. Mr. Simpson <br />said at least they aren't holding up as well as the two benches <br />under discussion. Commissioner Wiggins added that one of the <br />problems we have encountered is that guarantees are beautiful <br />things. They put them in nice documents -- scroll work and.every- <br />thing- -but when it comes time to get someone to perform on these <br />guarantees, it is always someone else's fault; never the guy who <br />guaranteed it. <br />Mr. Slabaugh said we have a three -year bond for maintenance. Com- <br />missioner Wiggins requested, "Let's get the ones fixed that are bad <br />and need fixing, but as far as I am concerned, I think we made it <br />pretty open and clear. If they are willing to bore a hole in there <br />and stick a bolt in- -fine, we will buy them; -if they don't, forget <br />it. They elected not to, so let them pick up their benches. Actually, <br />we probably need to get into this whole situation of seating. Maybe <br />not this group; in fact, I am not sure this is our responsibility. <br />Perhaps it is the Board of Works' responsibility at this point, but <br />I think the whole business of seating needs some thought and applica- <br />tion. I don't think it can be resolved by a matter of two benches <br />anyway. I think there is a number of benches that ought to be in- <br />cluded in this and they should probably all look alike." <br />r. Simpson asked various questions -on additional seating, in the <br />ompleted and not completed areas on the Plaza, with answers from <br />resident Nimtz, Commissioner Wiggins and Mr. Brownell, that there <br />ill be additional seating and it is in the contract being advertised <br />ow for the Plaza completion, for additional seating both in the <br />ompleted area and not completed area. <br />he Chair asked Mr. Edward F. Soltesz, as our unofficial and unpaid <br />onsultant on this matter, if he had anything further to add to the <br />bove. Mr. Soltesz said he had nothing further to add, but that <br />e does want to thank the Commissioners that they have not changed <br />heir tenure from the last meeting to this one. <br />n response to the Chair's request for a motion, Commissioner Wiggins <br />gain stated the motion was made at the last meeting- -kind of open and <br />hut- -with no change from the other Commissioners or objections. <br />he Chair directed Mr. Simpson to have the firm pick up the two benches <br />n question.
