NEWIBUSINESS (Cont'd <br />Summarizing further questions by Mr. Evans and answers by Mr. <br />Brownell: The letter is only requesting the appraisal and value <br />of the land, with the answer being the land cannot be appraised <br />until we have the proper land use. What was not stated in the <br />letter, per Mr. Brownell, is in their negotiations with him they <br />are talking about a change in the land use4, The present zoning <br />is for public parking and partly commercial, and- it;was envisioned <br />that there would be a building on that property with public parking <br />below and commercial use above. <br />Commissioner Wiggins said if we went ahead with this and it were <br />possible for them to do what they proposed to do, it would be <br />a very minor use for that amount of land. About the time you did <br />it, a short time later you might get a proposal from some corpora- <br />tion who may want to locate their home office here and build a <br />building and have the bus terminal underneath, and then we wouldn't <br />be able to do anything about it. The land use that we have set up <br />on that property is not the land use that would accommodate what <br />the Bus Company wants to do. Appraisal under the terms of this <br />land use would be meaningless to the Bus Company because they can't <br />use the land under these terms. For us to change the land use is <br />an involved procedure and we don't want this to develop in that <br />manner anyway, so it just becomes kind of a mute question actually <br />in terms of appraisal. <br />The motion was carried as noted above. <br />b. <br />Commercial Lease, <br />R -66: Authorization was requested to enter <br />COMMERCIAL <br />into a Commercial <br />Lease with John Spagnolo and <br />the Department of <br />LEASE AP- <br />Redevelopment, at <br />114 South Michigan Street, on <br />month -to -month <br />PROVED, <br />basis, commencing <br />November 1, 1975, as a fruit <br />and vegetable <br />114 SOUTH <br />market, in rental <br />amount of $200.00 per month, <br />which includes <br />MICHIGAN, <br />the utilities (heat, water and electricity) no <br />other costs, <br />R -66 <br />Project Indiana R -66. <br />Mr. Spagnolo was present and said he wanted to thank the people <br />who gave him the opportunity to further South Bend, and "I am <br />not one of those hypocrites, so to speak, who sits back.and com- <br />plains about South Bend not doing anything. Now I have a chance <br />to do something. We brought people downtown. You gave me that <br />opportunity. I have proven it; the town has proven it- -that <br />South Bend has survived downtown- -River Bend Plaza. I was not <br />only being a good humanitarian, but we are making money'. That's <br />what it's all about." <br />President Nimtz thanked Mr. Spagnolo for his very complimentary <br />letter he had in the "Voice of the People." <br />Mr. Wiggins stated that we appreciate Mr. Spagnolo's activity <br />on the Plaza and he would be very happy to move for the authori- <br />zation of the lease, as noted above. This is a month -to -month <br />lease, with Mr. Spagnolo expecting to remain for two months- - <br />until the end of the year. Motion was seconded by Mr. Chenney <br />and carried.
