6. NEW BUSINESS (Cont'd 37 and 38, with the stipulation that the control of the Notice to Proceed for Demolition & Site Clearance Contract No. 37 rests with the South Bend Redevelopment Commissioners, for internal control of the River Bend Plaza Office. Contract No. 37 is to be for the demolition of the River Bend Plaza Office, at 112 South Michigan Street (Parcel No. 8-6), and the vacant store building previously used by Office Engineers for storage, at 114 South Michigan Street (Parcel No. 8 -4), at an engineer's estimate of $14,486.25. At this time, Mr. Brownell said he would like to ask the Com- mission to authorize him, as the Executive Director, to issue the Notice to Proceed "when we get the contract ready for that purpose so that we do not have to wait, at that time, for the next Redevelopment Commission meeting, to receive approval to issue the Notice to Proceed." What was held back, by our re- quest, was the authorization to issue a Notice to Proceed, without bringing it before the Commission for approval. This approval is requested at this point to give the authorization to the Executive Director, Mr. C. Wayne Brownell. An opinion was requested from the Commission Legal Counsel present, Mr. Charles A. Sweeney, who approved taking the action requested. A lengthy discussion followed on the awarding of the Demoli- tion & Site Clearance Contract No. 37, relating to the sub- ordinate bid which is pending before the Commission for the purchase of the building by Mr. Karl King for Office Engineers. Mr. King had submitted a bid on Parcel No. 4 -30a. Mr. King stated he might be able to use the building and may have a tenant for it and he specifically would object if we would demolish the buildings prior to the acceptance of the bids. Mr. Brownell assured Mr. King that we do not have a right to demolish that building as Mr. King has a subordinate bid in to rehabilitate that building if the first bidder does not take the entire area that is covered by the Letter of Credit, then the purchase would go to Mr. King. The Letter of Credit expires at the end of this month. The request is only to act if we would need to act. On motion by Mr. Wiggins, seconded by Mr. Chenney and carried, the Executive Director, Mr. C. Wayne Brownell, was authorized to issue a Notice to Proceed, on Demolition & Site Clearance Contract No. 37, when the Department of Redevelopment is ready to proceed on that phase of the contract in the future. - 11 -
