6. NEW BUSINESS (Cont'd <br />37 and 38, with the stipulation that the control of the <br />Notice to Proceed for Demolition & Site Clearance Contract <br />No. 37 rests with the South Bend Redevelopment Commissioners, <br />for internal control of the River Bend Plaza Office. <br />Contract No. 37 is to be for the demolition of the River <br />Bend Plaza Office, at 112 South Michigan Street (Parcel No. <br />8-6), and the vacant store building previously used by Office <br />Engineers for storage, at 114 South Michigan Street (Parcel <br />No. 8 -4), at an engineer's estimate of $14,486.25. <br />At this time, Mr. Brownell said he would like to ask the Com- <br />mission to authorize him, as the Executive Director, to issue <br />the Notice to Proceed "when we get the contract ready for that <br />purpose so that we do not have to wait, at that time, for the <br />next Redevelopment Commission meeting, to receive approval to <br />issue the Notice to Proceed." What was held back, by our re- <br />quest, was the authorization to issue a Notice to Proceed, <br />without bringing it before the Commission for approval. This <br />approval is requested at this point to give the authorization <br />to the Executive Director, Mr. C. Wayne Brownell. <br />An opinion was requested from the Commission Legal Counsel <br />present, Mr. Charles A. Sweeney, who approved taking the <br />action requested. <br />A lengthy discussion followed on the awarding of the Demoli- <br />tion & Site Clearance Contract No. 37, relating to the sub- <br />ordinate bid which is pending before the Commission for the <br />purchase of the building by Mr. Karl King for Office Engineers. <br />Mr. King had submitted a bid on Parcel No. 4 -30a. Mr. King <br />stated he might be able to use the building and may have a <br />tenant for it and he specifically would object if we would <br />demolish the buildings prior to the acceptance of the bids. <br />Mr. Brownell assured Mr. King that we do not have a right to <br />demolish that building as Mr. King has a subordinate bid in <br />to rehabilitate that building if the first bidder does not <br />take the entire area that is covered by the Letter of Credit, <br />then the purchase would go to Mr. King. The Letter of Credit <br />expires at the end of this month. <br />The request is only to act if we would need to act. <br />On motion by Mr. Wiggins, seconded by Mr. Chenney and carried, <br />the Executive Director, Mr. C. Wayne Brownell, was authorized <br />to issue a Notice to Proceed, on Demolition & Site Clearance <br />Contract No. 37, when the Department of Redevelopment is ready <br />to proceed on that phase of the contract in the future. <br />- 11 - <br />
