Mr. Bill Slabaugh, with <br />the Board of Works, said that is a HUD requirement that <br />the utilities be on the "As- Built" plans. <br />President Nimtz "thanked" Mr. Kagel for his concern and <br />follow -up on this and we will continue to see that this <br />is done. Mr. Brownell said he is sure that Bill Slabaugh <br />and Pat McMahon will "stay on top of this." <br />On motion by Mr. Donaldson, seconded by Mr. Wiggins and carried, <br />the above letters were to be received and placed on file. <br />OLD BUSINESS <br />a. Columbia Warehouse Litigation, R -66: Mr. Charles A. <br />Sweeney, Jr., Legal Counsel, gave an update of the liti- <br />gation filed by Stanz Cheese, Presbyterian Players, <br />Inwood's and Ira Martz, against the City of South Bend, <br />the Department of Redevelopment, the Columbia Storage <br />Warehouse and S & W Construction Company, for damages <br />resulting from the Columbia Storage Warehouse fire on <br />October 5, 1971. <br />Mr. Sweeney advised the claims were settled, on Tuesday, <br />March 4, 1975, for a contribution of $14,500.00 from <br />the Department of Redevelopment. This was a conditional <br />settlement and Mr. Sweeney requested Commission approval' <br />for the negotiated settlement of $14,.500.00. He advised <br />Mr. Thomas Murray represented CNA Insurance Company, the <br />insurance carrier for the City of South Bend, and con- <br />tributed $22,500.00, which makes a total settlement of <br />$37,500.00. <br />President Nimtz requested the record to show that he <br />"does not represent any of these people and never has." <br />Mr. Wiggins made the motion that we accept the settle- <br />ment contribution of $14,500.00, with a "vote of con- <br />fidence and thanks" to our Legal Counsel representing us, <br />Mr. Charles A. Sweeney. Motion was seconded by Mr. Donald- <br />son and carried. <br />b. Update on meeting with HUD officials, in Indianapolis, <br />re proposed Plaza Park Contracts 1 and 2, R -66: Mr. C. <br />Wayne Brownell advised that he and Mr. Dan Lawson, with <br />Lawson Associates, went to Indianapolis and met with <br />the HUD officials. They agreed they would send us a <br />letter regarding the procedure for Contract No. 1 and <br />the bidding.
