7. <br />EW BUSINESS (Cont'd <br />President Nimtz requested Mr. Kevin J. Butler's legal <br />opinion on this item, as it is his understanding, as <br />Commissioner Wiggins brought up that we will be reim- <br />bursed for these salaries, and if.he felt we need a <br />motion to ratify this arrangement? Mr. Butler advised <br />affirmatively and said it should be formalized by the <br />members of the Commission - -that the understanding <br />should be formalized in the form of a motion. <br />Commissioner Wiggins made the motion for the approval <br />of this procedure as outlined, subject to the formal <br />submission by the Department of Community Development, <br />and the approval of our legal staff. Motion was se- <br />conded by Commissioner Chenney and carried. <br />Mr. Gene Evans, Executive Director,, South Bend Civic <br />Planning Association asked how many people are in- <br />volved in this? Mr. Brownell advised the relocation <br />people, the E.E.O. people, the Housing Bureau Chief, <br />and one or two other people who are on the staff. <br />These people will continue working the same as they <br />have been. When the advance funds are received for <br />Community Development, our Department will be reim- <br />bursed for the retroactive amount. <br />GRESS REPORTS <br />. Central Downtown Urban Renewal Project, R -66: <br />1) River Bend Plaza Construction Report: <br />Mr. C. Wayne Brownell, Executive Director, advised <br />we have one problem, and that is in the tearing <br />down of the King's building and the three -story <br />building adjoining it. The Gas Company claims <br />they have to tear up the sidewalk in front of <br />King's. In checking this out recently with Mr. <br />Bill E. Slabaugh, Department of Public Works, it <br />seemed to Mr. Brownell that they should be able <br />to turn the gas off by the sidewalk and cut it <br />off by the property line. <br />Mr. Slabaugh advised that the Gas Company will <br />try to cut the gas off at the end of the property <br />line and not disturb the sidewalk. <br />The question directed to some of the "old timers <br />on the Commission" as to whether we had run into <br />this type of problem prior, Commissioner Wiggins <br />responded that on some of these, they have had <br />some trouble in finding the shut -offs, foot valves, <br />and that sort of thing. <br />- 5 - <br />RIVER BEND PLAZA <br />CONSTRUCTION REPORT <br />
