5. LD BUSINESS (Cont'd
Mrs. Hernandez advised this had been discussed at
their Wednesday night meeting, had been continued
again at a meeting last night which she did not
attend and didn't feel she could discuss last night's
meeting. She felt there are a few corrections they
want to make, but that she didn't have the list with
her.
Mr. Lennon said the ordinance calls for a Public Hearing,
and, then as long as the intent and spirit of the ordinance
was not changed, the administrative guidelines can be
changed, subject to review of the Advisory Committee. Ms.
Marzy Bauer advised in this morning's meeting, and in
discussion with Reverend Frank Senns on the additional
corrections, she understood that these would be brought
on a conditional basis to the Advisory Committee, but
they didn't feel there was anything that really would
change anything on the guidelines. If there are any
minor corrections, they can be adopted by the Advisory
Committee at a later date.
The Chair asked if there are any other comments or ques-
tions by the public? President Nimtz asked if the Com-
missioners have any comments or questions - -any comments?
Whether the Commission Legal Counsel has any comments,
to which Mr. Butler answered, "None, whatsoever."
Commissioner Wiggins stated the only thing he was con-
cerned about in the past was the protection of the people
under land contract. However, he sees that a reasonable
interest has been determined here as a part of the eli-
gibility and he would assume also that it is just a manage-
ment function- -that a determination be made that the con-
tract itself was of standard nature and would protect the
"holder of interest." Mrs. Hernandez said that this was
one of their major concerns, that there be protection to
the holder of the contract, especially after the improve-
ments were made.
Mr. Lennon stated with that in mind he would recommend
that we do accept - -under the conditions so stated and
with the full authority of the Advisory Committee meeting
as of this morning - -and approve the guidelines as esta-
blished.
The Chair stated, there being no formal objections entered
to this Project, the Chair will now entertain a motion for
the approval of the Project..
On motion by Mr. Wiggins, seconded by Mr. Chenney -- anid
again to the Chair's question if there is any further dis-
cussion, there being none -- the "ayes " being unanimous,
the motion was carried, per above:
