PROGRESS REPORTS (Cont'd) <br />Mr. Simpson advised he has been working on a few <br />problems and doing.research on some: <br />a) Bikes - -a continual situation. <br />b) Commended the people responsible for the <br />maintenance of the River Bend Plaza. There <br />has been a terrific improvement. <br />c) Other problems: We do not have enough seats <br />on the River Bend Plaza, need outdoor ash trays, <br />and the complaints of the wall sitters. <br />d) Photo -Hut: Mr. Simpson said he had called Mr. <br />Lewellan, on Tuesday or Wednesday, and had a long <br />discussion with him, as he was supposed to remove <br />the Photo -Hut last Sunday. Mr. Simpson stated <br />he believes the owners of the Photo -Hut plan to be <br />very dilatory about moving the Hut. <br />A discussion followed on whether it would be legal <br />for the city to remove the Hut. There is no lease. <br />The Board of Works is working on this. <br />In answer to President Helmen's question on why this <br />hasn't been brought before the Advisory Board, Mr. <br />Lennon advised they haven't met in the past four <br />weeks, since Mr. Jack Ellis resigned. Additional <br />people have been added to the Advisory Board and <br />their function is to advise Lou Wilcox and to use <br />his judgment. No permanent facility is to be placed <br />on the Plaza and permission is needed for any unit <br />to be placed on the supergraphics which should be <br />mobile units. The Board of Works had authorized <br />the Photo -Hut to be placed there and since have re- <br />scinded their action. Mr. Lennon advised that we <br />do own the Plaza, but he is not sure we have the <br />right to physically remove it. This may need to be <br />a compromise situation. If it is not moved we may <br />have to move it. <br />Kevin Butler, Commission Legal Counsel, advised it <br />basically depends on the rights he is located there. <br />If it is a lease situation, it would have to be <br />taken to court. (The answer was that it is not a <br />lease situation). <br />Mr. Simpson advised the Board of Works had approved <br />the move and that it was rescinded, and we are will- <br />ing to reimburse the owners of the Photo -Hut for the <br />vending license fees., <br />- 11 - <br />
