2. PIPBLIC HEARING (Cont'd
"3. That this Commission does not have jurisdictions
o authority to pass, adopt, and /or ratify said resolution.
"DATED this 3 day of August, 1973.
/s/ Arthur A. May
Arthur A. May
Attorney for Daniel A. Clark"
The a ove questions (designated "Q ") were by Mr. May, and the
answe s (designated "A ") were by the Executive Director of the
Depar ms
of Redevelopment, Mr. Charles F. Lennon, Jr.
Mr. Lennon asked if there are any other remonstrances or comments
to be made. The next request was by Mrs. Janet S. Allen and Mr.
Lennon asked if she would go to the podium and identify herself
for the public record.
Mts. Janet Allen, 125 West Marion:
Q I have a question. Sometime ago, we urged that the Avon
Theatre be acquired along with the other properties along
the corner that were to be demolished. And now as I under-
stand it, they are talking about acquiring the Avon Theatre,
or is this simply to get them to renovate their building
because it would seem unwise to go in now at this late date
and try to tear that building out between Baer's and the
new building which is built?
A. Putting it back on the acquisition list is for planning
purposes only. We have been in contact with the Avon
Theatre owners and the management, and we have no inten-
tion at this time to demolish the building. If, however,
something should happen and they decide not to rehab that
building, this Commission wants the authority to go ahead
and proceed, and at this time this is true of all four
parcels.
Q. You are also making allowances for the properties in back
of the Morris Auditorium, I would assume?
A. Yes, Ma'am.
Q. So that they're not - the heating plants -- and any
restrictions on enlarging the auditorium will not happen?
A. The sole purpose for putting it back on the acquisition
list is the 1972 Burns Statute that gives the Redevelop-
ment Commission the opportunity for planning purposes to
have it back on. If something would develop in the next
year or so where a developer would like a parcel of land,
it now becomes available, without having to go through
again on types of hearings, etc.
-5-
