2. PUBLIC HEARING Cont °d) <br />Q. I understand that, but on the resolution which was <br />preliminary resolution adopted four, five, six...there <br />wasn't any such indications in there and I do have a <br />problem as far as that is concerned. I also, on be- <br />half of Daniel Clark, as I understand the sole purpose <br />of this Resolution is to place these four parcels of <br />property which you have listed back on the acquisition <br />list? <br />A. That is correct, as amended by the Burns Statutes. <br />Q. Right. I understand there isn't any intent of the <br />Resolution to in any way affect the Clark Parcel 4 -14, <br />the acquisition parcel? <br />A. That is correct. <br />Q. Thank you. Pursuant thereto, I am for purposes of <br />the record, I will file a written remonstrance. <br />Mr. Ma attorney for Mr. Daniel A. Clark, submitted copies of his <br />remons rance to each member of the Commission and Legal Counsel, <br />and th written remonstrance was received. The Remonstrance reads <br />as fol ows: <br />"REMONSTRANCE TO CITY OF SOUTH BEND REDEVELOPMENT COMMISSION <br />Re: Resolution No. 456 <br />"Notice is hereby given that the undersigned, Daniel A. <br />Clark, does hereby remonstrate and object to the adoption of <br />the resolution of the Commission adopted on the 16th day of <br />July, 1973 relative to the Downtown Urban Renewal Project, <br />Indiana R -66, also referred to as Resolution No. 456, upon <br />t e following grounds: <br />111. That the determination that certain areas of South <br />Bend were blighted within the description set forth in said <br />resolution and cannot be corrected by regulatory process or <br />by the ordinary operation of private enterprise has pre - <br />v ously been determined by this Commission on a previous <br />r solution. That this Commission does not have any power <br />o authority to adopt such a second resolution pertaining <br />t the same subject matter. <br />"2. That the area encompassed within the description <br />set forth in said resolution and notice of hearing thereon <br />is not blighted in that new buildings have been erected and <br />created within said described area and new businesses have <br />been established, that buildings have been torn down within <br />that area that could not be corrected according to said regu- <br />latory process or the operation of private enterprise and that <br />said area encompassed in said description is not at this time <br />a blighted area. <br />-4- <br />
