JULY 31, 2007 <br />NORTHERN INDIANA CONSTRUCTION CO., INC. <br />EMPLOYEE DRUG TESTING PLAN <br />It is the policy of Northern Indiana Construction co., Inc. to maintain a drug -free <br />workplace and to conduct testing as required by Indiana law (IC-4-13-18) to discourage <br />use of prohibited substances by our employees. Our drug -testing program consists of the <br />following steps: <br />1) All truck drivers who are subject to the drug and alcohol -testing requirements <br />of 49CFR Parts 40 and 382 will continue to be tested subject to those <br />requirements rather than according to this policy. <br />2) All field employees, both management and trade, who work on state public <br />works contracts are subject to testing by random selection. All field employees <br />will be subject to a drug test at least one (1) time each year. <br />3) The names of all field employees has been submitted to Beacon Occupational <br />Health, 4630 Vistula Road, Mishawka, Indiana 46544 our drug -testing agency, <br />they have entered the names into their database for random selection. The list of <br />employees will be updated as needed to reflect the change in status of any <br />employees as well as to add any new employees. <br />4) At least two percent (2%) of the subject employees will randomly be selected <br />for testing each month. If two percent (2%) of the subject employees is less than <br />one (1), at least one name will be randomly selected. <br />5) Within 72 hours of being selected or prior to the employee's next scheduled <br />day of work, whichever is later, the employee selected for testing will be notified <br />that he/she has been randomly selected. <br />6) Once an employee has been notified of his/her selection for testing, the <br />employee will be directed to Beacon Occupational Health, 4630 Vistula Road, <br />Mishawka, Indiana 46544, our current testing facility for Northern Indiana <br />Construction Co., Inc. The employee will have 48 hours from the time of <br />notification to provide a specimen at the designated facility. Proof that the <br />specimen was collected, within the allotted time must be provided by the <br />employee to Northern Indiana Construction Co., Inc. <br />
