7) Specimens will be tested for amphetamines, cocaine, opiates (2000ng/ml), <br />PCP, and THC. <br />8) All drug tests will be conducted as follows: by a laboratory certified by the <br />United States Department of Health and Human Services under the National <br />Laboratory Certification Program. <br />9) All test results shall be: sent by the laboratory to the Medical Review Officer <br />(MRO) designated by Northern Indiana Construction Co., Inc. <br />10) The concentration thresholds established by (under) 49 CFR Part 40.87, will <br />determine whether a drug -test is positive or negative. <br />11) If the MRO notifies Northern Indiana Construction Co., Inc. that an employee <br />has tested positive, the following disciplinary progression will be followed, unless <br />Northern Indiana Construction Co., Inc. determines that it is in the company's <br />best interest to terminate the employee: <br />(A) After the first positive test, an employee must be: <br />(i) <br />Suspended from work for thirty (30) days; <br />(ii) <br />Directed to a program of treatment or rehabilitation; and <br />(iii) <br />Subject to unannounced drug testing for one (1) year, beginning <br />the day the employee returns to work. <br />(B) After the <br />second positive test, an employee must be: <br />(i) <br />Suspended from work for ninety (90) days; <br />(ii) <br />Directed to a program of treatment or rehabilitation; and <br />(iii) <br />Subject to unannounced drug testing for one (1) year, beginning <br />the day the employee returns to work. <br />(C) After the <br />third or subsequent positive test, an employee must be: <br />(i) <br />Suspended from work for one (1) year; <br />(ii) <br />Directed to a program of treatment or rehabilitation; and <br />(iii) <br />Subject to unannounced drug testing for one (1) year, beginning <br />the day the employee returns to work. <br />12) All subcontracts for work to be performed on state public works contracts will <br />include a provision requiring the subcontractor to have a drug testing plan <br />(program) that complies with IC 4-13-18 and to provide information regarding <br />implementation of its drug testing plan (program) upon request of the owner <br />agency. <br />Revised on 7/18/2019 <br />
