BOWEN SAFETY POLICY MANUAL <br />The cost for re -testing will be at the expense of the employee <br />b. In the event of a second (2nd) offense, the employee will be <br />terminated for a minimum of one (1) year. Employee must show <br />proof of attending a mandated Substance Abuse Professional <br />(SAP), produce a negative drug test, and be subject to periodic <br />drug testing. <br />C. In the event of a third (3rd) offense, the employee will be <br />permanently terminated. <br />d. After a five (5) year period, from the date of the most resent offense, <br />assuming no other offenses/events have taken place, employees will be <br />granted one (1) reset period. (Le. when an employee has their first event <br />and does not have another event for a five (5) year period from the first, <br />then the offenses resets.) <br />8. Workers refusing to use SAP services following a, first (Vt) or second (2n1) <br />offense, positive test result will be permanently terminated. <br />9. Any terminated employee due to substance abuse, will need to provide <br />documentation of Counseling from an SAP and will be subject to frequent <br />drug testing. <br />10. For Union Employees all aspects of this program shall be subject to the <br />grievance procedure spelled out in their collective bargaining agreement. <br />11. Disciplinary procedures and rehabilitation guidelines for employees who <br />participate in union funded programs may vary. Bowen, when signatory <br />to a specific union, may recognize and comply with said procedures. <br />12. All of the above will be implemented and monitored by the Human <br />Resources Manager. Bowen has given complete authority to the Human <br />Resources Manager to implement the above stated steps. Any questions <br />that may arise should be directed to the Human Resources Manager. <br />E. Confidentiality <br />1. The identifying code for a test specimen(s) will be the employee's social <br />security number. <br />2. A suspected non -negative test result will first be reported to the <br />employee, and secondly to Bowen, by the Medical Review Officer (MRO). <br />If the MRO is unable to contact an employee within a reasonable amount <br />of time (not to exceed 72 hours) Bowen will be the only one contacted. <br />Last Revised: May 2016 Section 3 Page 15 <br />
