BOWEN SAFETY POLICY MANUAL <br />D. Bowen will establish an ongoing drug -free awareness program designed to inform <br />employees of (a) the dangers of drug abuse in the workplace, (b) Bowen's policy <br />of maintaining a drug -free workplace, (c) penalties that may be imposed for drug <br />abuse violations. Bowen will establish an Employee Assistance Program (EAP) to <br />include counseling for employees classified as part of Bowen management staff. <br />E. If an employee is convicted of violating any criminal drug statute and that <br />violation occurred in the workplace, the employee must notify Bowen in writing <br />of this fact no later than five (5) calendar days after the conviction. <br />F, Within ten (10) days after receiving such notice of the conviction, Bowen, in turn, <br />must notify the contracting Federal and State and Local Agencies, in writing, of <br />the employee's conviction. Bowen's notice will include the employee's name and <br />position or title. Reference Form 003-3.2-01 Drug -free Workplace Act Criminal <br />Drug Statue Violation. <br />G. If an employee is convicted for a criminal drug statute violation that occurred in <br />the workplace, within thirty (30) calendar days after receiving notice of that fact, <br />Bowen will take appropriate personnel action against the employee up to and <br />including termination, and/or will require the employee's satisfactory <br />participation in a drug abuse assistance or rehabilitation program. As a condition of continued employment with Bowen, employees must abide by <br />the terms of this Notice. <br />This policy and testing program is also designed to meet the substance abuse <br />testing requirements for employees that operate vehicles that require a <br />Commercial Driver's License (CDL). All CDL holders are required to be tested in <br />accordance with DOT regulations, 49 CFR Part 40 and 382, as amended. All testing <br />procedures for CDL holders will comply with DOT regulations. (state or federal) <br />J. DOT covered employees are considered to be performing a DOT safety -sensitive <br />function when they are performing, ready to perform, or immediately available <br />to perform any of the following functions: <br />a. All time spent at a company facility waiting to be dispatched. <br />b. All time inspecting, servicing, or conditioning any commercial motor <br />vehicle at any time. <br />c. All driving time or time spent at the driving controls of a commercial <br />vehicle in operation. <br />d.
