BOWEN SAFETY POLICY MANUAL <br />SECTION 3 - DRUG -FREE WORKPLACE POLICY <br />3.1 NOTICE TO SUPERVISION <br />RE: Drug -Free Workplace Policy/Notice to Employees <br />A. Post the Drug -Free Workplace Policy/Notice to Employees on your safety bulletin <br />board. <br />B. Have all new employees read policy and sign acknowledgment. <br />C. Workplace Supervision is trained in drug and alcohol awareness and has the <br />ability to execute the guidelines set forth in this section. <br />3.2 NOTICE TO EMPLOYEES REGARDING THE FEDERAL DRUG -FREE WORKPLACE ACT <br />"Conviction" means a finding of guilt (including a plea of nolo contendere) or imposition of <br />sentence, or both, by any judicial body charged with the responsibility to determine violations <br />of the federal or state criminal drug statutes. <br />"Criminal drug statute" means a criminal statute involving manufacture, distribution, <br />dispensation, use or possession of any controlled substance. <br />"Controlled substance" means a controlled substance in schedules I though V of Section 202 of <br />the Controlled Substance Act (21 U.S.C. 812). <br />"Workplace" means a site for the performance of work done in connection with a specific grant <br />or contract of a federal or state agency and any place a Bowen employee performs work. <br />A, Bowen has contracts with the Federal Government and other State and Local <br />Agencies, therefore, it is covered by the Drug -Free Workplace Act of 1988 and its <br />Final Rule published May 25, 1990. We must certify to the Federal Government <br />and other State and Local Agencies that we will provide a drug -free workplace. <br />This Notice is given in compliance with the requirement. <br />B. The unlawful manufacture, distribution, dispensation, possession or use of a <br />controlled substance in our workplace is prohibited. Controlled substances are <br />those identified in Schedules I though V of Section 202 of the Controlled <br />Substance Act and in Regulation 21 C.F.R. Section 1308.11-15. <br />C. Violations of this provision will result in discipline up to and including termination <br />and/or a requirement that the employee satisfactorily participate in a drug abuse <br />assistance or rehabilitation program approved by a federal, state or local agency. <br />Last Revised: May 2016 Section 3 Page 1 <br />
