9.0 Release of Medical Information to Outside Parties Regarding Substance Screen Test <br />Results <br />9.1 Medical information regarding substance screen testing results will be released to <br />outside parties by the Designated Employer's Representative (DER) or V.P. of <br />Human Resources ONLY under the following conditions: <br />9.1.1 In response to a written request on the form "Safety Performance Histoi <br />ql;r 5 Request" as required by the federal Motor Carrier Safety <br />Regulation 49 CIaR Part 40. This information will be released to the <br />requesting employer on said form. <br />9.1.2 As a result of a Workers' Compensation Claim in which the substance <br />testing was positive and where that substance presence was likely to have <br />been related to the claim. This information will be released to the <br />Insurance Company or its representatives. <br />9.1.3 In connection with an investigation by a governmental agency, i.e., <br />Unemployment Compensation Commission, Labor Relations agencies, <br />etc. <br />9.1.4 In response to a subpoena or court order. <br />9.1.5 As otherwise authorized by the co-worker. <br />10.0 Searches and Inspections <br />10.1 High reserves the right, at all times, while on the premises and properties previously <br />described, and if circumstances warrant due to reasonable suspicion, to conduct <br />searches and inspections of co-workers' lockers, baggage, wallets, purses, desks, tool <br />boxes, clothing and personal or company vehicles or any other personal objects <br />brought into the workplace, for the purpose of determining if such co-workers are in <br />possession, use, transportation, or concealment of any prohibited items; i.e., illegal <br />drugs, controlled substances, alcohol, and drug paraphernalia. Acceptance of <br />employment by the Company constitutes consent to reasonable searches and <br />inspections under this policy. <br />10.2 Searches of a co -worker's person and/or inspections can be conducted by a member <br />of management when he/she has reasonable suspicion that the co-worker is in <br />violation of this policy and determines that a search is reasonably necessary to <br />establish whether a violation exists. <br />10.3 Searches will be conducted in the presence of a witness with due regard to the <br />privacy, dignity and gender of the individual being searched. A witness can be a <br />plant manager, general superintendent/foreman, supervisor, foreman/leadperson or <br />other responsible person of the same gender as the individual being searched. <br />10.4 The company Human Resources Representative must be notified as soon as <br />practicable. <br />10.5 Co-workers found to be in possession of or transporting drugs or alcohol in <br />violation of this policy will be subject to immediate suspension and subject to <br />Page 10 <br />Supersedes Policy Number/Dated: 01/01/06 Policy Number 2-662 <br />Approved by: Larry Brown Effective Date: 08/01/08 <br />
