does not exceed or fall short of, the requirements set forth in 49 C.F.R. Parts 40 <br />and 199. In the event that one of the plans does not satisfy this requirement while <br />the other does, Northern Indiana NECA/LU 153 will continue to adopt and <br />incorporate the latter plan, only. <br />(B) In compliance with 49 C.F.R. Section 199.11, each affiliated contractor/operator <br />(a person who owns or operates pipeline facilities subject to part 192, 193, or 195 <br />of Chapter 1 of 49 C.F.R.) shall conduct the following drug tests for the presence <br />of a prohibited drug: <br />(1) Pre -employment testing; <br />(2) Post -accident testing; <br />(3) Random Testing: Each operator shall administer, every 12 months, a <br />number of random drug tests at a rate equal to 50 percent of its employees.: <br />Each operator shall select employees for testing by using a random <br />number generator that is matched with an employee's social security <br />number, or other appropriate identification number; <br />(4) Testing based on reasonable cause; and, <br />(5) Return to duty testing. <br />(6) Retesting of covered employees with an alcohol concentration of 0.02 or <br />greater but less than 0.04. <br />(C) Each Northern Indiana NECA/LU 153 affiliated contractor subject to 49 C.F.R. <br />Part 40 and/or 199 shall be solely responsible for the following matters in the <br />administration of the plans identified in paragraph A of Section II; <br />
