(1) selection of its own Drug Program Manager (DPM) who shall perform all <br />of the duties of the DPM, except for administering and maintaining the <br />actual drug test and its results, which shall be maintained by Northern <br />Indiana NECA/LU 153 and/or its independent contractors; <br />(2) selection and/or determination of all work, job classifications and <br />employees who are subject to the requirements of 49 C.F.R. Parts 40 and <br />199. <br />(3) make all determinations as to post -accident testing (i.e., whether testing is <br />required, who should be tested, etc.), be solely responsible for transporting <br />the employee to and from the testing site, be solely responsible for any <br />compensation due the employee, and be solely responsible for all record <br />keeping concerning said testing. <br />(4) make the selection by a random process of who should be tested for <br />random testing in accord with paragraph (B) (3) in Section II. <br />(5) make all determinations as to reasonable cause testing (e.g., whether <br />testing is required, who should be tested, etc.), be solely responsible for all <br />record keeping concerning said testing. <br />(D) While the words "solely responsible" are used in the above paragraph and sub- <br />paragraphs, these words are intended to make it clear that it is Northern Indiana <br />NECA/LU 153 affiliated contractor and not Northern Indiana NECA/LU 153 which <br />is ultimately responsible for compliance with 40 C.F.R.
