submitted themselves to testing in the appropriate timeframe. If the member fails to comply with <br />the testing request, the contractor can at that time decide if any disciplinary action is needed. <br />At the end of the two -week window, the administrator will review the original testing list for that <br />month and provide a reminder letter that will be mailed directly to the member's home. This <br />letter will inform the member that they had been selected for testing and to date have not <br />submitted themselves for the required tests. The member will be given ten days form the date of <br />the letter to submit for testing. If the fail to do so, they will be placed in the ineligible pool. <br />All Employees of eligible Employers will be paid a $35.00 participation stipend beginning with <br />the June 2018 Random and $40.00 beginning with the June 2019 Random for submitting to the <br />testing. This stipend will be paid from the Health and Welfare Fund. The list of those tested for <br />the month will be generated by the Plan Administrator and forwarded to TIC for issuance of the <br />participation stipend. A copy of the form letters notifying individuals of their selection for this <br />test appears as an attachment at the back of this booklet. <br />Individuals may also be tested if there is `probable cause" to suspect that an individual's work <br />performance or on-the-job behavior is affected in any way by drugs or alcohol. The "probable <br />cause" standard is limited to any on-the-job accident, where there is a fatality, serious bodily <br />injury or significant property damage. Serious bodily injury will be defined as an injury that <br />requires an immediate hospital stay of over twenty-four (24) hours. For the purpose of this <br />program significant property damage will be defined as those incidents where an insurance <br />company claim may be involved. <br />
