Section 3.10. On Jobs having a foreman, workmen are not to take directions or orders, or accept layout of any job <br />from anyone except the foreman, except in an emergency. <br />PREFABRICATION <br />Section 3.11. When an Employer elects to self -perform electrical prefabrication activities outside the jobsite, the <br />workforce shall consist of IBEW Local 153 Members. A traveling signatory contractor shall be allowed to utilize their <br />existing prefabrication facilities as long as the facility is manned by Local IBEW Members in their home jurisdictions <br />under the agreement. The ratio of Journeyman to Apprentice/ Construction, Wiremen/ Construction electricians shall <br />be at the Employer's discretion. However, there must be, at a minimum one (one) Journeyman to supervise the prefab <br />facility. The total number of the non journeyman performing these prefabrication activities shall count toward the total <br />shop ratio allowed under this agreement. <br />TRANSPORTATION OF TOOLS / MATERIAL AND PRIVATE CELL PHONE USAGE <br />Section 3.12. No workman shall use any automobile, motorcycle or other vehicle in a manner considered by the <br />UNION to be unfair to other workmen, or against the best interest of the UNION. The Union shall not consider it to be <br />unfair to other workmen or against the best interest of the Union for a worker to transport personal protective <br />equipment that is furnished by the Employer inany, automobile, motorcycle, or other vehicle. The use of personal <br />cell phones being used for company business is prohibited, <br />COPE VOLUNTARY DEDUCT <br />Section 3.13. The Employer agrees to deduct and transmit to IBEW-COPE an amount often cents ($.10) per hour <br />from the wages of each employee who voluntarily authorizes such contributions on the forms provided for that <br />purpose by IBEW-COPE. <br />These transmittals shall occur monthly and shall be accompanied by a list of the names of those employees for <br />whom such deductions have been made and the amount deducted for each such employee. <br />REFUSAL OF OVERTIME <br />Section 3.14. No Employee will be penalized in any manner for refusing overtime. <br />SHOW -UP TIME <br />Section 3.15. Any workmen reporting for work and being laid off, not having been notified the day previous of <br />such lay- off, shall receive not less than two (2) hours wages in order to gather his tools and personal belongings <br />and shall be paid off in full immediately.. In the event the workman is not paid off, waiting time at tite regular rate <br />shall be charged until payment is made. When workmen are directed to report to a job and do not start work due to <br />lack of material, or other causes beyond their control they shall receive two (2) hours pay unless notified one hour <br />before starting time of that day. <br />Section 3.16. Workman shall report to the shop or on the job ready to work at the scheduled starting time. <br />WORK ON ENERGIZED CIRCUITS OF 440V <br />Section 3.17. On all energized circuits of 440 volts or over, as a safety measure, two or more Journeymen must <br />work together. <br />Section 3.18. Workmen shall install all electrical work in a safe and workmanlike manner and in accordance with the <br />applicable code and contract specifications. <br />Section 3.19. A Journeyman shall be required to make corrections on improper workmanship for which he is <br />proven responsible, on his own time during regular working hours, unless errors were made by orders of the <br />EMPLOYER or the EMPLOYER'S representative. The EMPLOYER shall notify the UNION of workmen who fail to <br />adjust improper workmanship, and the UNION will thereupon diligently and in good faith induces such workmen to <br />comply with the requirements of this provision. <br />Section 3.20. No employee shall be required to use any tool, which requires an explosive to operate. <br />HIGH TIME <br />Section 3.21. For hazardous work performed from a free fall height of forty (40) feet, workmen shall be paid on the <br />10 <br />
