ANCON CONSTRUCTION CO., INC. <br />DRUGFREE WORKPLACE POLICY continued <br />3) A five (5) drug panel will be used, which tests for the following: <br />a) Amphetamines, <br />b) Cocaine, <br />c) Opiates (2000 ng/ml) <br />d) PCP <br />e) THC <br />In the case of an incident on the job, everyone involved in the incident will be tested. This will also include <br />incidents that do not involve personal injury. Employees should note that if an on-the-job incident is <br />caused by abuse of a controlled substance, the law does not require Workers Compensation to pay medical <br />or disability expenses of the worker abusing the substance. <br />An employee reporting for work visibly impaired or is unable to properly perform required duties will not <br />be allowed to work. Ancon Construction has the right to search its premises and property at all times and <br />without prior notice to employees and/or in employees' absence. Ancon Construction will pursue this right <br />to insure that the illegal use, possession, sale, distribution, exchange, or consumption of prohibited drugs <br />does not take place on company premises/jobsites or have anything to do with the job performance of its <br />employees. Persons discovered to be violating the criminal laws of the applicable jurisdiction will be <br />reported to police authorities and dealt with by such authorities in the fashion that others who have <br />violated the criminal laws are treated. <br />A medical testing laboratory approved by Ancon Construction conducts all testing. Test results will be kept <br />confidential with only persons who are HIPPA certified to view that information. <br />An employee who tests positive is immediately suspended from working for thirty (30 days). As a condition <br />of continued employment with Ancon Construction, an employee who tests positive, but has not tested <br />positive in any previous test, must enroll, at their own expense, in a certified drug abuse program. It is the <br />employee's responsibility to seek out and complete a certified treatment program. (For information on <br />substance abuse services and charges covered by Ancon's Employee Benefit Plan, see the Summary Plan <br />Description, page 19, (11) Mental Health and Substance Abuse Services.) At the time of enrollment, the <br />employee must agree to allow information on their participation and progress in the program to be <br />released to the Human Resource Manager. <br />Following a minimum of thirty (30) days' suspension, if the Human Resource Manager has determined that <br />the employee is enrolled and participating satisfactorily in a certified drug abuse program which allows <br />them to work, and after testing negative on a five (5) drug panel test certified by the company's medical <br />review officer, the suspension may be lifted and the employee may be allowed to return to work at Ancon's <br />sole discretion. <br />If an employee enrolls in an in -patient program which precludes working while participating in the <br />program, they may, at Ancon's sole discretion, be allowed to return to work after presenting the Human <br />Resource Manager with a doctor's release authorizing return to work and after testing negative on a five (5) <br />drug panel test certified by the company's medical review officer. The Human Resource Manager will <br />monitor the employee's progress in the program; a missed session or any other failure to complete <br />requirements of the program is cause for immediate termination. An employee who has completed a drug <br />abuse program and returned to work is subject to unannounced drug testing, for one (1) year, beginning <br />the day the employee returns to work. Any employee who fails a subsequent drug or alcohol test at any <br />time in the future will be terminated. <br />2 <br />
