ANCON CONSTRUCTION CO., INC. <br />8.0 DRUG -FREE WORKPLACE POLICY <br />(Compliant with IN CODE IC 4-13-18-5) <br />8.1 Introduction <br />Recognizing that drug use creates problems in the work environment, Ancon Construction has established a <br />drug policy designed to keep all work areas drug free and safe, to treat all its employees fairly and <br />respectfully, to assure its customers that the highest professional standards are maintained at all times, <br />and to comply with the Drug -Free Workplace Act of 1988. This policy prohibits the unlawful manufacture, <br />distribution, dispensing, possession or use of controlled substances on company premises. It also prohibits <br />Ancon employees, and others working on company premises, from reporting for work or working with any <br />detectable levels of alcohol or other controlled substances in their systems. <br />8.2 Information and Training <br />To inform employees of the health and safety hazards of substance abuse, especially in the work place, <br />Ancon will provide periodic training and orientation programs for all its employees. This training will <br />include information about available drug rehabilitation programs. Information on drug rehabilitation <br />programs may also be obtained from the Human Resource Manager, any local hospital, an individual's <br />physician, or by looking in the yellow pages of the telephone book under Drug Abuse & Addiction. <br />8.3 Requirements <br />As a condition of employment, all employees of Ancon Construction must agree to abide by the terms of its <br />drug policy and to notify Ancon of any criminal drug statute conviction for a violation occurring in the <br />workplace no later than five days after a conviction. This Policy does not, in any way, modify Ancon's <br />adherence to its employment -at -will policy. Refusal by a new or current employee to take a drug test is <br />cause for immediate termination. <br />8.4 New Employees <br />Prior to employment, all applicants are screened for drug usage. This screening is performed by an <br />authorized medical provider with a Medical Review Officer on staff. To receive an offer of employment, an <br />applicant must provide a valid specimen which tests negative. There are no exceptions to this policy. An <br />applicant with anything other than a valid, negative test result will not be reconsidered for employment for <br />a 12-month period. <br />8.5 Current Employees <br />Current employees will be tested: <br />a) If an owner requires drug testing for a specific job; <br />b) if they are involved in an incident on the job; <br />c) if the Ancon Superintendent or Foreman in charge at a job site has reasonable cause to <br />suspect the employee is using or has used illegal drugs or is abusing or has abused alcohol, <br />d) in random testing of employees, In compliance with Indiana code for Public Works <br />Contractors on all public works contracts: <br />1) Each employee will be subject to a drug test at least one (1) time each year. <br />2) At least 2% of all employees company -wide will be randomly selected each month <br />for testing. <br />
