<br />WHEREAS, the Board of Public storks of the City of South. Bend, Indiana
<br />did, on the 20th.,da.y of May °1919 adopt a preliminary resolution for the improvement
<br />of MARQUEE'1'E PARK SEWER 8YSTEM,` Vhd4R' Impr°ovement Res olutlon No. 679. In the City of
<br />South Bend, Ind iana,° by construction of a sewer, also the construction of the necessary
<br />manholes,, and inlets':, storm water inlets,° conduits and resetting all manholes and in-
<br />lets t o the pr per. grade.,.. A, L as. shown on the plans and in accordance with the prof ilea
<br />detail drawings and speclf oat.ions. om f110, in. the off ice of the Department of Public
<br />Works,
<br />AND WHEREAS, we, rho undersigned,, are the only person owing property
<br />on said street to be improved, and that we alone are affected in any way by said proposed
<br />improvements,, That we are the sole owners of the separate parcels of land bordering
<br />upon said street proposed to be improved. °
<br />Therefore, ifs consideration that said Board of Public Works proceed,
<br />to Imp ove said streets in Marquttto Park as proposed in. said Resolution, and for the
<br />further purpose of`sa g time and expense, we he undsrsA#ned, do hereby waiveall
<br />object ions' en and defense to any defect in said proceedings, and to any violation in proved
<br />for the construction of sewers as fixed by Section 8722 of Burn,'s . Revised Statutes of
<br />1914. We further waive any right to object to the form of said res olut ion. We further
<br />waive any and all objections to the fact that no advertisement for bearing has been
<br />published as required by law, and that no notices were mailed to the owners of property
<br />and that no hear ing °was held by said Board.
<br />We also consent that said Board shall proceed to let the contract for doing
<br />said work in the following manner: -
<br />That they shall notify by mail responible zorAtactors in the City of South
<br />Bend, Indiana of said work to be done under said resolution, and that they shall receive
<br />bids from said contractor for doing of said work, and they shall let the contract for the
<br />doing of said work to the lowest res puns ible bidder. And we waive any objection to the
<br />action of said Board In letting said contract in a form and manner other than provided
<br />by law.
<br />.And .we further iibnaent that th4 cost of doing said Work shall be assessed a
<br />against the different parcels of reel estate owned by us as provided by See.tions,87221,
<br />8723 a, 87249 8725,8726,8727. 87280, and all acts and laws.amendatory thereof or supple-
<br />mental thereto.
<br />And we further agree that notice given us by mail, shall be suggicient
<br />novice of the bearing upon the assessmtsts made for said improvement.

<br />the form of waiver hereto attached, a copy of which is made a part hereof. The said
<br />waiver to be filed with the City of South Bend, Indiana, concerning_ the method and
<br />procedure itsed in the letting of a contract for a sewer system In. Marquette Park, South
<br />Bend, Indiana.
