<br />The following contract was approved by the Board.
<br />CONTRACT.
<br />THIS AGREMENT made and entered into this 20th. , day of May 1919
<br />by and between L. H. VanderKarr, party of the first part, and the City of South
<br />Bend, Indiana, by its Board_ of Public Works, party of the second part , WITNESSEKM
<br />That for and in consideration of the parties hereinafter stated, to be
<br />paid to the party pf the first part by the party of the second part, the said
<br />party of the first Part hereby agrees to repair all asphalt pavements in the streets
<br />of said City under the direction of the Street Commissioner and to furnish all
<br />materials and labor required In dobt g said work until January lst., 1920. All of
<br />said re Nair ing is to be done at places as directed by the Street Commissioner of
<br />said City, or by his deputy. Saud party of the first part agrees to use first
<br />class material in dot#g said work, and he further agrees to use first class mater ial.
<br />it dot#g said work, and he further agrees to place barricades and red lights at
<br />the places where said: repair work is being done by him, in such manner as to protect
<br />all persons, in using said street, from injury.
<br />In consideration of the performance of said work by the party of the
<br />first part. the said party of the second part agrees to pay hits therefor the sum of
<br />Two Dollars and thirty five cents ($2.35# per sq. yd. for all resurfacing and re-
<br />pair work , except Where the grouting or foundation concrete is broken through or' in
<br />suchcondition that it cannot be used, in which instance the party of the first part
<br />shall receive three ($3. 00) Dollars per square yard. Said sums are to be paid after
<br />said work has been inspected and approved by the Street C ommiss ioner of said City,
<br />or by the City Civil Engineer.
<br />The party of the first part further agrees that he will do all work
<br />in a good workmanlike manner, and that he hereby guarantees all of said repair
<br />work to be and --remain in .good condition for a period of one year from the time` such
<br />re^air work Is done; and if duAing said year, said repair work so done should, be-
<br />e ore defective, the- party of the f first part agrees to re :.lace the same, with ,good,
<br />material or upon fail.'To to do so, to refund to said City the amount .received by him
<br />for such repairing.
<br />And. said party ofr the first part further agrees to indemnify and,_ save
<br />harmless the -said party of the second part from all damages to any person or propert
<br />by reason of the negligent performance of said Work by the party of the first part,
<br />And said party Of the first part further agrees that after repairing any placed
<br />In any of the streets of said City, ate will immediately thereafter remove all dirt
<br />and refuse to the curb of said street.
<br />And it is further agreed that the party of the first past may use all
<br />material taken out of the street repaired by him, which material is to in first
<br />class condition a.nd suitable to be used in doing said repair work..
<br />And said party of the second part, as a part of the consideration of
<br />this contract, agrees to loan to said party of the first part, asphalt plant, all
<br />asphalt tools, which is now owns, and said party` of the first part agrees to pay
<br />for the use of the same and for such time as said tolls are actually used, give (5)
<br />cents per sq. yd. of asphalt surface laid and said f first part agrees to keep said
<br />tools and plant in good repair and return the same to said party of the second part
<br />in good condition less natural wear and tear,
